<br />WHEREAS, the Village ha s been unable to negotiate for <br />the purpose of purchasing said land; and <br /> <br />WHEREAS, under the statutes of the State of Minnesota <br />the Village has the power to take and acquire such property by power <br />of eminent domain; <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE <br />COUNCIL OF THE VILLAGE OF ROSEVILLE, MINNESOTA, AS FOLLOWS: <br /> <br />The Village Council hereby deems it necessary and <br />convenient that the property described below be acquired by the Village <br />of Roseville for the Roseville Park, all of said property being situate in <br />the Village of Roseville, County of Ramsey and State of Minnesota, to-wit: <br /> <br />Lots Three (3) and Four (4), Block Two (2), <br />Weinholzer' s Addition, according to the plat <br />thereof on file and of record in the office of <br />the Registrar of Titles in and for Ramsey <br />County, Minnesota. <br /> <br />BE IT FURTHER RESOLVED: <br /> <br />1. <br /> <br />That the estate to be acquired is fee simple <br /> <br />absolute. <br /> <br />2. That the Village Attorney be and he hereby is <br />instructed to institute the necessary proceedings in condemnation under <br />the power of eminent domain in the name and in behalf of the Village <br />of Roseville, Minnesota, to acquire the property hereinabove described <br />under the statutes of the State of Minnesota, and the said Village Attorney <br />is further instructed and directed to take such steps as may be necessary <br />to carry said proceedings to a conclusion. <br /> <br />The motion for the adoption of the foregOing resolution <br />was duly seconded by Member Goodrich, and upon a vote being held, <br />all members present voted in favor thereof, none voted against; <br /> <br />WHEREUPON, the said Resolution was declared duly <br />passed and adopted. <br /> <br />-2- <br />
