<br />WHEREAS, the present owners and other persons having <br />an interest in said required lands have indicated that they are unwilling <br />to negotiate with the Village on a reasonable basis for the acquisition of <br />the same; and <br /> <br />WHEREAS, the statutes of the State of Minnesota state that <br />the Village has the power and authority to take and acquire said property <br />by condemnation under the power of eminent domain: <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL <br />OF THE VILLAGE OF ROSEVILLE, MINNESOTA, AS FOLLOWS: <br /> <br />1. The Village Council hereby deems that it is necessary <br />and convenient that a perpetual easement be acquired by said Village by <br />condemnation under the powers of eminent domain over, under and across <br />that real property being situated in the County of Ramsey and State of <br />Minnesota, and legally described in Exhibits 1 through 7 attached hereto <br />and hereby made a part hereof. <br /> <br />2. That the e state to be acquired in the real property <br />described in Exhibits 1 through 7 is a perpetual easement for public road <br />and highway purposes, and for underground utility mains, pipes and <br />appurtenances over, under and across the said real property. <br /> <br />3. That the Village Attorney be and he hereby is instructed <br />to institute the necessary proceedings in condemnation under the power <br />of eminent domain in the name and in behalf of the Village of RoseviUe, <br />Minnesota, to acquire the property described in Exhibits 1 through 7 <br />attached hereto under the statutes of the State of Minnesota; and the said <br />Village Attorney is further instructed and directed to take such steps as <br />may be necessary to carry said proceedings to a conclusion. <br /> <br />The motion for the adoption of the forego ing resolution was <br />7,.. , <br />duly seconded by Member .L.2-c--t---ct'L-c-t ./~ , and upon a vote being <br />held, the follOWing voted in favor of the resolution: <br /> <br />d... <'c le/L( ,L<: <br />:./ <br /> <br />and the following voted against the same: <br /> <br />7/ ';-;;'\..-'- <br /> <br />WHEREUPON, said resolution was declared duly passed and <br /> <br />adopted. <br /> <br />Page Two <br />
