<br />,/j <br /> <br />," / <br /> <br />A motion for the adoption of the following Resolution was presented by Erickson. <br /> <br />RES 0 L UTI 0 N <br /> <br />BE IT RESOLVED by the Village Council of the Village of <br />St. Anthony, a Municipal corporation, State of Minnesotaz <br /> <br />1. The Village of St. Anthony hereby assigns to the <br />Village of Roseville all the rights and privileges of the Minnesota Water <br />Company, a Mi nnesota corporati on, under the terms of the contract entered <br />into between said Water Company and the Village of St. Anthony on August 9, <br />1960. <br /> <br />2. The terms of this contract insofar as they apply to <br />the Village of Roseville, are hereby amended by amending Paragraph 7 of said <br />contract. Paragraph 7 of said contract will read as follows insofar as it <br />applies to the Village of Roseville: <br /> <br />"7. The terms of thi s agreement sha 11 be for a peri od <br />of thirty (30) years from the date hereof, but shall be <br />subject to termination on the part of the Village of <br />Roseville in the event the Village of Roseville should <br />construct any water producing facilities which could <br />serve the land subject to this agreement. Said termination <br />of the contract by the Village of Roseville shall be made <br />by a resolution adopted by the Village of Roseville, a <br />certified copy mailed to the Village Council of the <br />Village of St. Anthony, and thirty (30) days prior to <br />the termination date.'1 <br /> <br />3. This resolution shall be null and void unless a <br />resolution is passed by the Village Council agreeing to abide by all the <br />terms of the contract as amended by this resolution within thirty (30) days. <br /> <br />4. The obligations of the Minnesota Water Company under this <br />contract shall terminate as of March 31, 1964, upon the Village of Roseville <br />adopting a resolution agreeing to abide by the terms of this contract as <br />amended. <br /> <br />WHEREUPON, said resolution was declared duly passed and <br /> <br />adopted. <br /> <br />The resolution was seconded by O'Connor. <br /> <br />Voting in favorz Erickson, Bailey, O'Connor, McNulty <br /> <br />Absent: Dougherty <br />I hereby certify that the foregoing resolution is <br />preceedings of the Village Council meeting of the <br />Minnesota, held on March 24, 1964. <br /> <br />a true copy from the <br />Village of St.Anthony, <br /> <br />SEAL <br /> <br />l J;~i; V.
