EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF ROSEVILLE, MINNESOTA - HELD October 18, 1976 * * * Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, Minnesota, was duly called and held at the City Hall in said City on October 18, 1976. The following members were present: Mayor Demos, Councilmen Curley, Grauel, Hess and Anderson and the following members were absent: None Member Anderson introduced the following Resolution and moved its adoption: RESOLUTION NO. 6431 A RESOLUTION DETERMINING TO ACQUIRE BY CONDEMNATION UNDER THE POWERS OF EMINENT DOMAIN CERTAIN LAND IN FEE SIMPLE FOR THE PURPOSE OF A PERMANENT EASEMENT FOR THE COLLECTION, STORAGE, AND PONDING OF WATERS, AND DIRECTING THAT THE NECESSARY PROCEEDINGS BE INSTITUTED FOR SUCH PURPOSE. WHEREAS, the City Council for the City of Roseville deems it necessary and expedient and in the best interests of the City to acquire the following described land for a permanent easement for the collection, storage, and ponding of waters; and WHEREAS, the City Council for the City of Roseville has been advised by competent advisers and committees that the following described real property is feasible to construct, maintain, operate and repair underground storm water lines wi thin said easement area and to excavate, fill and slope as may be necessary for ponding and storage of surface waters, together with ingress and egress; and WHEREAS, the City of Roseville has been unable to negotiate for the purpose of purchasing said land; and WHEREAS, Under the Statutes of the State of Minnesota, the City has the power to take and acquire such property by power of eminent domain; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF ROSEVILLE, MINNESOTA, AS FOLLOWS: The City Council hereby deems it necessary and convenient that the property described below be acquired by the City of Roseville in fee simple for the purpose of a ponding easement
