Johnson, Wiski, Goedeke, and V. Johnson, and the following were absent: None. Councilmember Goedeke introduced the following resolution and moved its adoption: RESOLUTION 9205 CIVIC CENTER DRIVE, CITY PROJECT P-95-12, S.AP. 160-240-02 WHEREAS Civic Center Drive hetween Woodhill Drive and Countv Road C-2 is deshmated as -'-J ----- ------ ----.- --- ----- - ---.- --- - -- - --- J t."...' Municipal State Aid roadway No. 240; and WHEREAS, the City ofRoseville wishes to use Municipal State Aid dollars for a mill and overlay project of Civic Center Drive; and WHEREAS, in order to use Municipal State Aid dollars, Civic Center Drive must meet Municipal State Air1 <:t~nr1~rr1<: mhil"h in('lnr1p<: Minnp<:nt~ Rnlp RR?() QQ4~ mhi('h rpllnirp<: ~ l()()-fnnt ¡'ori7ont~1 r~ciill" for . ~~ ~_~..__. _~ ....._.. ..._.___~ H~"'''_~_ __ ~__._ ___ ~. _ _ . _ .. ..._u . -'"1_u _~ _ _ _ _ __ _ _ _______ u___ _ _____ ___ a 30 mph design speed curve; and WHEREAS, the current design for the horizontal curves of Civic Center Drive are 100 feet and 75 feet respectively; and WHEREAS, if the State Aid design standards cannot be met, a variance must be granted to allow the use of Municipal State Aid dollars to be spent on Civic Center Drive; and WHEREAS, the City ofRoseville has applied for a variance and received conditional approval for the variance to Civic Center Drive; and WHEREAS, the condition of this approval is the receipt of a resolution by the Roseville City Council that holds harmless the State of Minnesota for granting a variance to Minnesota State Aid street No. 240 between W oodhill Drive and County Road C. NûW TI-i.bREFûRE BE IT RESûLvbD by the Council oîthe City ofRoseviile, Minnesota that the City ofRoseville indemnifies, saves, and holds harmless the State of Minnesota and its agents and employees of and ±rom any and all claims, demands, actions, or cause of action arising out of or by reason of the resurfacing of Municipal State Aid street No. 240 between Woodhill Drive and County Road C in accordance with Minnesota Rule 8820.9945; and the City ofRoseville agrees to defend at their sole cost and expense any action or proceeding commenced for the purpose of asserting any claim of whatsoever character arising as a result of the granting of this variance.
