Regular City Council Meeting <br /> Monday, December 13, 2010 <br /> Page 14 <br /> what process would apply for these proposed performance standards versus Con- <br /> ditional Use criteria. <br /> Also, related to when building permits were processed, were similar questioned <br /> asked on those applications to determine if and how the applicant met those stan- <br /> dards; and whether that was part of the administrative process or assumed. <br /> Ms. Dushin addressed CONTROL MEASURES and where they were now lo- <br /> cated in the proposed text; opining that among various drafts, they appeared to <br /> have been removed, and Ms. Dushin expressed her preference that they be reins- <br /> tated unless they were addressed elsewhere in the document. <br /> Ms. Dushin noted that the Planning Commission minutes had not been posted on <br /> the City's website since June of 2010; and asked that they added. <br /> Depending on the PERFORMANCE STANDARDS response, Ms. Dushin asked <br /> that the table addressing chemicals not involving "noxious" odors be addressed <br /> and stated as a positive, rather than the previous double negative. <br /> Mr. Trudgeon advised that in the PERFORMANCE STAN- <br /> DARDS /ENVIRONMENTAL REGULATIONS, the first statement applied to all <br /> uses; with any existing use needing to comply or correct their actions to be com- <br /> pliant, or they were not a permitted use. <br /> Mr. Trudgeon advised that all applicants for building permits must demonstrate <br /> compliance, an outcome of previous discussions over the summer, which will be a <br /> new procedure for us, and new language will be added to building permit applica- <br /> tion forms as indicated. Mr. Trudgeon advised that it was the intent of staff that <br /> applicants would demonstration in writing the impacts and how they intend to <br /> meet those standards, at which time staff will review them and determine if they <br /> are acceptable or not. <br /> Related to CONTROL MEASURES, Mr. Trudgeon advised that the language <br /> proposed in I -2A ZONIND DISTRICT was currently on the books; with only one <br /> (1) parcel in the entire City zoned for that heavy manufacturing use. Mr. Trudge <br /> on advised in staff's review of the laundry list in the existing code, several were <br /> already contained in other areas of the proposed code (noise and traffic) and other <br /> items (delivery; security of premises or buildings) were puzzling and staff ques- <br /> tioned whether staff should or could review and /or enforce. <br /> Mr. Trudgeon advised that he had recently noted the omission of Planning Com- <br /> mission meeting minutes on the City's website, and advised that would be cor- <br /> rected at staff's earliest convenience. <br />
