1407 Planning Commission in response to the proposal of the City Planner, questioning how the <br /> 1408 neighborhood benefited from approving this application <br /> 1409 Associate City Planner Bryan Lloyd <br /> 1410 Mr. Lloyd provided a brief summary of the proposed subdivision heard at the City Council level <br /> 1411 for this lot on Marion Road, currently consisting of two lots substantially larger than today's <br /> 1412 minimum standards, and unrelated to the rezoning proposal to lower minimum lot sizes to bring a <br /> 1413 major portion of existing residential lots into compliance with City Code. Mr. Lloyd advised that <br /> 1414 the lots in question could be subdivided under today's regulations; and that the proposed rezoning <br /> 1415 would not increase the number of new lots in this parcel; and explained that a developer would <br /> 1416 have to buy a minimum eight (8) contiguous, conforming parcels and combine them all together <br /> 1417 before an additional ninth (9 parcel could be created. <br /> 1418 Mr. Disney disputed and questioned Mr. Lloyd's comments and staff s support of the proposed <br /> 1419 subdivision. Mr. Disney alleged that the Commission was not familiar with this neighborhood to <br /> 1420 provide an informed opinion and needed to do a site visit as representatives of the City of <br /> 1421 Roseville and members of the Planning Commission. <br /> 1422 Chair Doherty asked Mr. Disney how the City or neighbors could dictate what a private property <br /> 1423 owner did on his own property, as long as it met existing City Code. <br /> 1424 Member Gisselquist noted, and Commissioners concurred that this issue was not before the <br /> 1425 Commission and not relevant to the rezoning discussion. <br /> 1426 Mr. Paschke addressed the allegations of Mr. Disney, stating that he was not aware that anyone in <br /> 1427 the Planning Division indicated to the applicant how many subdivided lots they should attempt to <br /> 1428 put on their property; however, the Associate Planner had indicated to the applicant that City <br /> 1429 Code allowed three (3) lots based on the total square footage. Mr. Paschke clarified that Minor <br /> 1430 Subdivisions went directly to the City Council for a public hearing. Mr. Paschke assured Mr. <br /> 1431 Disney that the Comprehensive Plan guided what occurred on parcels and it was not the intent of <br /> 1432 City staff to change anyone's neighborhood, but to apply the City Code. Mr. Paschke noted that <br /> 1433 this neighborhood was unique, but that to -date, there had been no proposal to create single <br /> 1434 family, large lot standards for the area in question; and without a proposal, staff was left with <br /> 1435 developing codes and ordinances consistent with the Comprehensive Plan. Mr. Paschke <br /> 1436 concurred with Mr. Lloyd that existing code would allow a similar subdivision, with only <br /> 1437 possibly one additional lot under the proposed rezoning code for 85' wide lots. Mr. Paschke noted <br /> 1438 that the neighborhood in question had been farms that had been subdivided to what they are <br /> 1439 today. Mr. Paschke noted that, while there may be concerns, staff was compelled to abide by the <br /> 1440 City's regulatory documents, which were guided by the Comprehensive Plan, as updated and the <br /> 1441 Imagine Roseville 2025 community visioning process. <br /> 1442 Mr. Disney repeated his concerns adamantly, specifically concerning the possibility of additional <br /> 1443 townhomes in the area that would further dramatically change the neighborhood, as allowed <br /> 1444 previously by the City for Gordy Howe's townhome development; and that by allowing any more <br /> 1445 housing density in the neighborhood, the City was betraying everyone who bought there. <br />
