The appeal for the petition will need to be
referred to the February 2, 2011 Planning Commission (per state statute). The appeal regarding the rezoning done by
the December 13th action by the City Council is not appealable, in staff's estimation, and thus it is not expected that the
Council will take any action regarding the zoning appeal.
Patrick Trudgeon, AICP
City of Roseville
Community Development Director
2660 Civic Center Drive
Roseville, MN 55113
(651) 792-7071
(651) 792-7070 (fax)
pat.trudgeon(aci.roseville.mn.us
www.ci.roseville.mn.us
From: R L MIX fmailto:rlmix(amsn.coml
Sent: Sunday, January 09, 2011 5:12 PM
To: *RVCouncil
Cc: Pat Trudgeon
Subject: Old Highway 8 Neighborhood appeal
Dear City Council ano Pat Trudgeon,
Please enter the attached document as testimony regarding the appeal of the decision of
the City and the Petition of the Old Highway 8 Neighborhood regarding the City-initiated
rezoning of two Old Highway 8 parcels.
I hope this provides some clarity to both the Petition and the Appeal. We have been
trying to act in good faith in our response to the City's desire to change zoning in our
neighborhood. The residents have demonstrated that the change is detrimental to the
safety and character of our neighborhood. We had no need to change the zoning and
we have no desire to tinker with the Comprehensive Plan, but we hope that the City will
make modifications if that's what it takes to reach a solution that is mutually agreeable.
Another note: I have read the on-line file for the meeting Monday night, January 10,
and am confused by the Q&A between Mayor Roe and Mr. Bartholdi. Are the Appeals
going to be heard tomorrow night? Our neighborhood was postcarded to attend
tomorrow night, but it sounds like there won't be any testimony? Is it merely a referral
back to the Planning Commission? Many of the residents in our group are elderly, don't
know how to use the Internet and have difficulty getting out in this weather. Also, the
"staff comments" section says a letter notifying us that " the Board of Adjustment and
Appeals does not take up appeals to legislative decisions..." was sent to me. I have
not received such a letter.
