Ms. Mix expressed frustration in having to return to the Planning <br /> Commission when they had originally supported the request of the neighborhood <br /> to rezone the property to MDR, Medium Density Residential, rather than the City <br /> Council decision to rezone the property to HDR, High Density Residential. <br /> Chair Roe advised that the Planning Commission would take under consideration <br /> whatever the applicant requested, and make their recommendation to the City <br /> Council based on the application itself <br /> Ms. Mix further questioned the timing and need for an open house. <br /> Chair Roe clarified that the open house was part of the application process prior to <br /> submission of the application and its being heard by the Planning Commission. <br /> Member Pust assured Ms. Mix that they had done nothing wrong in the process, <br /> and clarified the appeal process under a new law, following the previous decision <br /> of the City Council. <br /> Member Willmus clarified that, if the neighbors so chose to do so, they could in- <br /> itiate rezoning of the properties at 3253 and 3261 Old Highway 8. <br /> Member McGehee opined that, if the group decided to proceed with an applica- <br /> tion for rezoning, that the City Manager be directed to have staff provide clear <br /> steps for the process to avoid similar confusion. <br /> City Manager Malinen assured the Board and public that staff is available to as- <br /> sist, as it served with any and all applications. <br /> Member McGehee opined that she wanted to see every step put in writing. <br /> Brian Buck,3609 33rd Avenue NE, St. Anthony Village <br /> Mr. Buck questioned if the neighborhood needed to be concerned, if it pursued <br /> rezoning, that the correct land use designation was applicable. <br /> Chair Roe noted that the zoning did need to comply with the Comprehensive Plan <br /> land use designation. <br /> Mr. Trudgeon advised that the two needed to conform; with the Zoning change <br /> approval or denial based on simple majority vote, but any Comprehensive Plan <br /> Amendment needing super majority vote. Mr. Trudgeon noted that the property <br /> owners at 3253 and 3261 Old Highway 8 may have concerns and challenge any <br /> determinations and require additional resolution. <br />
