Planning Commission Meeting <br />Minutes – Wednesday, June 02, 2010 <br />Page 6 <br />At the request of Commissioners, Mr. Paschke again provided the history of the <br />249 <br />parcel since 1979, when Har Mar Mall was guided for Shopping Center zoning <br />250 <br />designation as guided by the previous Comprehensive Plan; with the <br />251 <br />Comprehensive Plan Steering Committee having spent considerable time on the <br />252 <br />appropriate designation for the Har Mar Mall as well as the Target development, <br />253 <br />whether designation as Community Business or Regional Business was more <br />254 <br />appropriate, with the majority making recommendation that Har Mar be <br />255 <br />designated Community Business. <br />256 <br />Mr. Schwie alleged that this request was being driven by Har Mar Mall; and <br />257 <br />opined that the southern parcels were currently zoned R-1. <br />258 <br />Mr. Paschke assured Mr. Schwie that this rezoning process was entirely city- <br />259 <br />initiated, and that the City was not seeking to intensify the area; and clarified that <br />260 <br />the Har Mar property had been guided “Shopping Center” since 1979, and noted <br />261 <br />that the reason Cub had to abide by its footprint was due to City not being willing <br />262 <br />to move a public easement to allow expansion. <br />263 <br />Mr. Schwie encouraged the Commission to hear the tone of those neighbors in <br />264 <br />attendance, and was not convinced by staff comments. <br />265 <br />Chair Doherty appeared that this was a common issue with people desiring to <br />266 <br />control what was done with a particular adjacent property not owned by them. <br />267 <br />Ron Draganowski, 1391 Shryer Avenue W <br />268 <br />Mr. Draganowski questioned whether Community Business designation could <br />269 <br />support multi-family housing above a business, such as development of <br />270 <br />apartments south of Har Mar Mall. <br />271 <br />Mr. Paschke advised that such a use would be designated Mixed Use, and that <br />272 <br />the southern property was of limited dimensions and probably not suited for that <br />273 <br />type of development, as well as reducing the required parking ratio that Har Mar <br />274 <br />Mall needed to maintain; and that an amendment to the Comprehensive Plan <br />275 <br />designation would be needed to allow other uses not within a Community <br />276 <br />Development zoning designation. <br />277 <br />Mr. Draganowski requested that the land use designation remain R-1 for the <br />278 <br />southern parcels adjacent to Har Mar Mall. <br />279 <br />J. O. Thompson, 2808 Asbury Street <br />280 <br />Mr. Thompson requested that the zoning remain R-1, and provided his <br />281 <br />perspective on the history of that designation for over fifty-eight (58) years, <br />282 <br />allowing for a buffer zone between the parking area and residential properties. <br />283 <br />Mr. Thompson disagreed with staff’s interpretation of the zoning, adamantly <br />284 <br />opining that it was designated as a Special Use Permit for parking in an R-1 <br />285 <br />zoning district, and remained as such today. <br />286 <br />Mr. Paschke advised that staff would attempt additional research on those <br />287 <br />parcels. Mr. Paschke noted that, if the Commission wished to recommend a <br />288 <br />change to the zoning designation, such action would require a separate and <br />289 <br />distinct recommendation to the City Council to modify land sue designations for <br />290 <br />the southern piece of Har Mar Mall. <br />291 <br />Annette Phillips, 3084 Shorewood Lane <br />292 <br />Ms. Phillips noted an error in the zoning map (dated May 2010) showing a lack of <br />293 <br />connection near Snelling and Lydia onto County Road C-2. <br />294 <br />Mr. Paschke noted the error, noting that it would be corrected on future <br />295 <br />printings. <br />296 <br />Ms. Phillips questioned whether the building on the northwest corner at the <br />297 <br />intersection of County Road C-2 and Lincoln Drive (former Edina Realty building) <br />298 <br /> <br />
