Mr. <br />857 <br />Grefenberg opined that environmental and quality of life standards were as <br />858 <br />important, if not more important, than design standards. <br />859 <br />Mr. Paschke challenged Mr. Grefenberg to identify on the Table of Uses where a <br />860 <br />stadium would be supported by this proposed code as an allowable use in an <br />861 <br />Industrial District. <br />862 <br />Mr. Grefenberg expressed his appreciation in receiving an answer to his <br />863 <br />concerns; and opined that the public should be encouraged to ask questions and <br />864 <br />seek information; and apologized if he seemed to be pointing a finger when he <br />865 <br />was only attempting to be honest with the C omission. <br />866 <br />Mr. Paschke noted that the public has been encouraged to ask questions an <br />867 <br />seek information through multiple formats and opportunities; and reminded the <br />868 <br />public that the Planning Commission did not make the decision, but only made a <br />869 <br />recommendation to the City Council; and that there would be additional <br />870 <br />opportunity before final adoption of the proposed code. <br />871 <br />Mr. Grefenberg expressed his interest in the Planning Commission having the <br />872 <br />final say for recommendation to the City Council, not staff; and opined that <br />873 <br />questioning should be encouraged by this body; and looked forward to future <br />874 <br />opportunities to address his concerns to the Commission. <br />875 <br />Chair Doherty asked that Mr. Paschke consider an alternate term to replace <br />876 <br />“contiguous” on page 7. <br />877 <br />Mr. Paschke suggested that Mr. Grefenberg provide staff with an e-mail or his <br />878 <br />thoughts on a replacement term to avoid any nebulous results. <br />879 <br />Discussion included potential terms such as “surrounding,” which was <br />880 <br />determined did not get to Mr. Grefenberg’s concerns, since “contiguous” <br />881 <br />addressed adjacent properties other than air emission concerns; noting that <br />882 <br />“surrounding” was already used in Section 1005.05 A.1, Statement of Purpose, <br />883 <br />as it related to adjacent properties. <br />884 <br />Mr. Grefenberg noted the tendency of attorneys to interpret words as they <br />885 <br />wished; and suggested that the same language be used rather than contiguous. <br />886 <br />Mr. Grefenberg noted that he was originally going to suggest “proximity,” but <br />887 <br />found problems with that term as well. <br />888 <br />Mr. Paschke asked that, if the Commission was considering a change to the draft <br />889 <br />language that they include it as an amendment to their recommended motion. <br />890 <br />Gretchen Ternes, 2328 Terminal Road, Suite B <br />891 <br />Ms. Ternes introduced herself as a business owner on Terminal Road, noting <br />892 <br />that she had received the post card notice regarding a change in zoning to <br />893 <br />Business Office Park; and sought a definition of that designation. Ms. Ternes <br />894 <br />noted that the majority of businesses along Terminal Road were involved in light <br />895 <br />assembly work and given most of those building’s internal structures, they would <br />896 <br />not be suitable to become offices. Ms. Ternes, while in agreement with the <br />897 <br />majority of the rezoning areas following more in-depth discussions with Associate <br />898 <br />Planner Bryan Lloyd prior to tonight’s meeting. Ms. Ternes pointed out potential <br />899 <br />areas of inconsistency (e.g. FedEx LTL and FedEx Freight) with similar uses but <br />900 <br />different zoning designations. <br />901 <br />Ms. Ternes expressed concern that the businesses along Terminal Road did not <br />902 <br />receive notice of the proposed asphalt plant, and noted that she had written <br />903 <br />several e-mails to Councilmember Dan Roe as well as other written <br />904 <br />communication regarding the proposed plant; and opined that the other business <br />905 <br />owners and/or tenants of those businesses needed notification as they were also <br />906 <br /> <br />
