Planning Commission Meeting <br />Minutes – Wednesday, November 17, 2010 <br />Page 3 <br />addressing components of processing on-site that may be more intensive then <br />98 <br />moving materials from one area of a site to another area. <br />99 <br />In Section 22, outdoor display sales areas were discussed, with proposed <br />100 <br />provisions not allowing any sales items allowed under the canopy of a fuel pump <br />101 <br />area, including stacks of mulch now commonly seen piled on pump islands. Staff <br />102 <br />advised that new code provisions were requiring those items to be up by the <br />103 <br />building or elsewhere on the site, not where customers were trying to pump gas <br />104 <br />or otherwise circulate; similar to conditions currently applied to Conditional Use <br />105 <br />permits for these items for the purpose of managing clutter and chaos on those <br />106 <br />sites. <br />107 <br />In a related note, Mr. Lloyd noted that staff was recommending larger right-of- <br />108 <br />way setbacks for drive-thru’s and gas stations not addressed in current code, <br />109 <br />given that those uses were typically busier, that those setbacks be fifty feet (50)’) <br />110 <br />rather than the current and standard forty feet (40’). <br />111 <br />In Section 24, discussion was held on motor vehicle sales and how new vehicles <br />112 <br />being converted for handicapped accessibility would be addressed, with staff <br />113 <br />defining new car dealerships being differentiated from those being modified for <br />114 <br />resale, and remaining an allowable use. <br />115 <br />Public Comment <br />116 <br />Vice Chair Boerigter closed the Public Hearing at 6:40 p.m., with no one <br />117 <br />appearing for or against. <br />118 <br />Vice Chair Boerigter opined that he was comfortable with the majority of this <br />119 <br />section, other than having continued questions on the motor vehicle section and <br />120 <br />how that related to motor vehicle sales, specific to conversion operations; his <br />121 <br />view that the recent dog kennel approval was not consistent with the increased <br />122 <br />distance requirements in the proposed code; and concern with drive-thru’s <br />123 <br />provisions being overly restrictive when addressing realistic application to <br />124 <br />facilitate safe movement on those sites. <br />125 <br />Further discussion included motor vehicle sales, depending on how they were <br />126 <br />defined under State law and requirements for licensing of such; with staff <br />127 <br />advising they would further review current uses, such as vehicle conversion <br />128 <br />businesses, to ensure they would still be supported under proposed language; <br />129 <br />and new vehicles sales, recognizing that used vehicle sales are restricted to <br />130 <br />dealerships selling new vehicles. <br />131 <br />MOTION <br />132 <br />Member Wozniak moved, seconded by Member Gisselquist to <br />133 <br />RECOMMEND TO THE CITY COUNCIL APPROVAL of DRAFT <br />134 <br />PROCEDURES ordinance as presented; and detailed in the Request for <br />135 <br />Planning Commission Action dated November 17, 2010. <br />136 <br />While supporting the PROCEDURES section overall, Vice Chair Boerigter <br />137 <br />reiterated his previous concerns related to drive-thru lanes. <br />138 <br />Ayes: 5 <br />139 <br />Nays: 0 <br />140 <br />Motion carried. <br />141 <br />b.
