Attachment B <br />AMENDMENT TO COOPERATIONAGREEMENT <br />Metropolitan Council Family Affordable Housing Program <br /> THIS AGREEMENT <br />is entered into between the Metropolitan Council, [the <br />Metropolitan Council] and the City of Roseville, Minnesota [Municipality]. <br />RECITALS <br /> WHEREAS, <br />the Metropolitan Council is a public corporation and political subdivision <br />of the State of Minnesota and is authorized by Minn. Stat. §473.195 to exercise the functions, <br />rights, duties, privileges, immunities and limitations as are provided for housing and <br />redevelopment authorities created by municipalities; and <br />WHEREAS, <br /> in conjunction with its Family Affordable Housing Program [FAHP] the <br />Metropolitan Council sought to acquire up to 15 residential housing units on a scattered site basis <br />in the Municipality [FAHP Units]; <br />WHEREAS, <br />the governing body of the Municipality granted approval of the acquisition <br />of the FAHP Units located in the Municipality; <br />WHEREAs, <br /> on May 30, 2001 the Metropolitan Council and the Municipality entered <br />into a Cooperation Agreement with respect to the acquisition and operation of the FAHP Units <br />within the Municipality; <br />WHEREAS, <br />since its inception, FAHP has been a public housing program funded under 42 <br />U.S.C. §1437a; <br /> WHEREAS, <br />in order to best preserve the FAHP Units as financially viable housing for <br />low-income families into the future, the Metropolitan Council applied to HUD for approval to <br />voluntarily convert the 150 FAHP Units from public housing units to Section 8 Project-based <br />Vouchers which will continue to be owned by the Metropolitan Council; and <br /> WHEREAS, <br />HUD has approved the conversion of the FAHP Units to Section 8 Project- <br />based Vouchers effective January 1, 2010; and <br /> WHEREAS, <br />the Metropolitan Council and the Municipality have agreed to amend the <br />Loan Agreement to provide for the conversion of the FAHP Units to Section 8 Project-based <br />Vouchers. <br /> NOW THEREFORE, <br />in consideration of the promises and covenants contained in this <br />Agreement, the Metropolitan Council and the Municipality agree that the Cooperation <br />Agreement, shall be amended as follows: <br />1. The Municipality consents to the conversion of the FAHP Units to units assisted under <br />the Section 8 Project-based Voucher Program as set forth in 42 U.S.C. §1437f, and 24 C.F.R. <br />Part 983 to be operated as PHA owned units under 24 C.F.R. §983.59. <br />ÉÐ3£ø 0 <br /> <br />
