EXTRACT OF MINUTES OF MEETING <br /> OF THE <br /> CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> Pursuant to due call and notice thereof, a regular meeting of the City Council of the City <br /> of Roseville, County of Ramsey, Minnesota was duly held on the 28 day of February <br /> 2011, at the Roseville City Hall at 6:00 p.m. <br /> The following members were present: Johnson; McGehee; Willmus; Pust; and Roe and <br /> the following were absent: none. <br /> Member Johnson introduced the following resolution and moved its adoption: <br /> RESOLUTION NO. 10883 <br /> A RESOLUTION FOR THE ACQUISITION OF A PERMANENT PATHWAY <br /> EASEMENT AND A TEMPORARY CONSTRUCTION EASEMENT USING <br /> EMINENT DOMAIN FOR A PORTION OF PROPERTY LOCATED AT 1595 <br /> HIGHWAY 36, CITY OF ROSEVILLE. <br /> WHEREAS, the City of Roseville proposes to construct sidewalks, trailways and other <br /> pathways and associated improvements within the City of Roseville as part of a regional <br /> trailway system; and <br /> WHEREAS, the City Council of the City has determined that the construction of such <br /> trailway system is in the public interest and promotes the public health, safety and <br /> welfare of the community; and <br /> WHEREAS, in order to construct the trailway system and improvements the City needs <br /> to acquire the permanent and temporary easements described in Exhibit A attached <br /> hereto; and <br /> WHEREAS, the City has been unable to successfully negotiate the acquisition of the <br /> above-referenced easements; and <br /> WHEREAS, the City has the power under Minn. Stat. Chapter 117 to take and acquire <br /> the above-referenced easements by way of eminent domain; and <br /> WHEREAS, the City Council of the City has determined that it is necessary to acquire <br /> the above-referenced easements prior to the filing of an award by the court appointed <br /> commissioners pursuant to Minn. Stat. § 117.042. <br /> NOW THEREFORE, BE IT RESOLVED: <br />
