• satisfactorily completed and the City has <br /> certified that those replacement trees are <br /> alive and healthy.To be certified as alive and <br /> healthy,all of the following conditions must <br /> exist: <br /> - No tree shall have sustained mechanical <br /> injury to the trunk of a tree causing <br /> loss of more than 30%of the bark <br /> circumference of the tree at any location <br /> along the tree's trunk. <br /> - No tree shall have had soil compacted to <br /> 6 inches deep over more than 30%of its <br /> root zone. <br /> - No tree shall have had more than 30% <br /> of its roots cut for the installation of any <br /> utility or for any other purpose. <br /> - No more than 25%of the crown of a <br /> tree shall consist of dead branches. <br /> d. None of a security shall be released until the <br /> developer's,contractor's,property owner's obligations <br /> to indemnify the City for any expenses incurred <br /> in enforcing the requirements of this Section are <br /> satisfied. <br /> • 10. Penalties for Violation:Any tree that is visibly damaged, <br /> has a root system that has been driven on,or has a root <br /> zone in which the soil has been compacted in any way, <br /> shall be replaced in accordance to the tree replacement <br /> formula found in Section 1011.04G.Also,any person <br /> who is not authorized by the City who removes any <br /> tree from any public property without first obtaining a <br /> permit and any person who fails to replace trees in the <br /> manner provided in this subsection shall,in addition to <br /> the criminal penalties prescribed by law,be required to <br /> pay to the City the estimated cost of tree replacement in <br /> the amount determined by the City.Upon determination <br /> that this has occurred,the City shall submit a bill for <br /> the amount of tree replacement.If that amount is not <br /> received by the City within 90 days,such amount shall <br /> be assessed as a special assessment on any land located in <br /> the City owned by the person violating this Section. <br /> B. Buffer Area Screening:The setback requirements established <br /> for uses in each district are intended to act as buffers <br /> between those districts and uses,but heightened screening <br /> is appropriate between low-density residential dwellings and <br /> more intensive uses.For all new construction in all districts <br /> that lie adjacent to or across the street from LDR Districts, <br /> therefore,additional screening shall be implemented as <br /> • required herein. <br />
