EXTRACT OF MINUTES OF MEETING OF CITY COUNCIL CITY OF ROSEVILLE RAMSEY COUNTY, MINNESOTA Pursuant to due call and notice thereof, the City Council of the City ofRoseville met in regular session at the City Hall on Monday, the thirteenth day of November, 1995, at 5:30 o'clock p.m. The following members were present: P. Johnson, Mastel, Goedeke, Wiski, and V. Johnson and the following were absent: None. Councilperson P. Johnson introduced and moved the adoption of the following resolution: RESOLUTION NO. 9249 APPEAL OF COMMISSIONERS' AWARD LAKELAND A VENUEIBENJAMIN'S CONDEMNATION CITY PROJECT P-93-10, LINCOLN DRIVE AUDITOR NO. 6525 WHEREAS, the City ofRoseville constructed Lincoln Drive ITom County Road C-2 to Lydia Avenue in 1994; and WHEREAS, right-of-way necessary to construct the roadway was acquired from Lakeland Avenue PropertiesIBenjamin's by eminent domain; and WHEREAS, the court appointed commissioners determined that the value of the taking was $140,000 which is considerably higher than the City's appraisal; and NOW THEREFORE BE IT RESOLVED by the Council of the City ofRoseville that the City of Roseville appeal the Award of the Commissioners in the sum of$140,500 for the taking of the Lakeland Avenue Properties II property for Improvement 93-10A, said action known as Ramsey County District Court File No. CO- 95-5148; and that Peterson, Bell, Converse and Jensen, P. A. be authorized to commence said appeal. The motion for the adoption of the foregoing resolution was duly seconded by Councilperson Mastel upon vote being taken thereon, the following voted in favor thereof: P. Johnson, Mastel, Goedeke, Wi ski, and V. Johnson and the following voted against the same: None whereupon said resolution was declared duly passed and adopted.
