EXTRACT OF MINUTES OF MEETING OF THE <br /> CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> Pursuant to due call and notice thereof, a regular meeting of the City Council of the City <br /> of Roseville, County of Ramsey, Minnesota, was held on the 18th day of April 2011 at 6:00 p.m. <br /> The following Members were present: Willmus; McGehee; Pust; Johnson; and Roe; <br /> and none were absent. <br /> Council Member Roe introduced the following resolution and moved its adoption: <br /> RESOLUTION NO. 10892 <br /> A RESOLUTION APPROVING AN ACCESSORY DWELLING UNIT AS A <br /> CONDITIONAL USE AT 3091 FAIRVIEW AVENUE (PF11-007) <br /> WHEREAS, Derek Thorson, applicant for approval of the proposed conditional use, <br /> owns the property at 3091 Fairview Avenue, which is legally described as: <br /> PIN:04-29-23-21-0073 <br /> Hedlund's Addition,the S 60 feet of Lot 3 and the N 36 feet of Lot 4 and the N 36 feet of the <br /> E 40 feet of Lot 9 and the S 60 feet of the E 40 feet of Lot 10, all in Block 1 <br /> WHEREAS, the Roseville Planning Commission held the public hearing regarding the <br /> proposed CONDITIONAL USE on April 6, 2011, voting 7-0 to recommend approval of the use based <br /> on the comments and findings of the staff report prepared for said public hearing; and <br /> WHEREAS, the Roseville City Council has determined that approval of the proposed <br /> CONDITIONAL USE will not result in adverse impacts to the surrounding properties based on the <br /> following findings: <br /> a. The proposed accessory dwelling unit is not in conflict with the Comprehensive <br /> Plan because it advances land use Policy 7.4 by promoting increased housing <br /> options in the community; <br /> b. The proposed use is not in conflict with a Regulating Map or other adopted plan <br /> because no such plans apply to the area surrounding the property; <br /> c. The proposed use is not in conflict with City Code requirements, and the <br /> conditional use approval can be rescinded if the use of the accessory dwelling unit <br /> fails at any time to comply with all applicable Code requirements or conditions of <br /> the approval; <br /> d. The proposed accessory dwelling unit, which is suitable for up to two occupants, <br /> will not create an excessive burden on parks, streets, and other public facilities; <br /> and <br /> e. The proposed accessory dwelling unit is a small residential use that will not be <br /> injurious to the surrounding residential neighborhood, will not negatively impact <br /> Page 1 of 3 <br />
