Roseville Public Works, Environment and
Transportation Commission
Date: May 24, 2011 Item No: 5
Item Description: Erosion Control Ordinance
Agenda Item
Background:
At the April 26 meeting the Commission discussed the proposed revisions to the Erosion
Control Ordinance. Attached are the comments that we received from that meeting. Staff has
updated the attached ordinance.
As mentioned previously, the intent of this ordinance update is to incorporate the findings from
the MPCA's Storm Water Pollution Prevention Program (SWPPP) audit, specifically fines. The
rest of the updates are more problems or "loop holes" that staff has found during the
implementation of this ordinance.
This purpose of this ordinance is to address the City's SWPPP, Minimum Control Measure 4-
Construction Site storm water runoff control. Specifically, MCM4a -1 requires that the City have
an ordinance or other regulatory mechanism to enforce construction site storm water runoff
control.
We have discussed the ordinance with the City Attorney, his recommendation is that we keep the
content of the ordinance focused on erosion control permitting. Incorporating too much
information into this section may limit the effectiveness of the regulation and be confusing for
enforcement.
This ordinance will be moved out of the Zoning Code and into the Storm Water Code,
specifically 803.04. This is the same chapter as the Illicit Discharge Ordinance (803.3) and the
future location of the City's Storm Water Drainage Ordinance.
Recommended Action:
Discuss recommended changes to the Erosion and Sedimentation Control Ordinance.
Attachments:
A.
