Roseville Public Works, Environment and <br />Transportation Commission <br />Date: May 24, 2011 Item No: 5 <br />Item Description: Erosion Control Ordinance <br />Agenda Item <br />Background: <br />At the April 26 meeting the Commission discussed the proposed revisions to the Erosion <br />Control Ordinance. Attached are the comments that we received from that meeting. Staff has <br />updated the attached ordinance. <br />As mentioned previously, the intent of this ordinance update is to incorporate the findings from <br />the MPCA's Storm Water Pollution Prevention Program (SWPPP) audit, specifically fines. The <br />rest of the updates are more problems or "loop holes" that staff has found during the <br />implementation of this ordinance. <br />This purpose of this ordinance is to address the City's SWPPP, Minimum Control Measure 4- <br />Construction Site storm water runoff control. Specifically, MCM4a -1 requires that the City have <br />an ordinance or other regulatory mechanism to enforce construction site storm water runoff <br />control. <br />We have discussed the ordinance with the City Attorney, his recommendation is that we keep the <br />content of the ordinance focused on erosion control permitting. Incorporating too much <br />information into this section may limit the effectiveness of the regulation and be confusing for <br />enforcement. <br />This ordinance will be moved out of the Zoning Code and into the Storm Water Code, <br />specifically 803.04. This is the same chapter as the Illicit Discharge Ordinance (803.3) and the <br />future location of the City's Storm Water Drainage Ordinance. <br />Recommended Action: <br />Discuss recommended changes to the Erosion and Sedimentation Control Ordinance. <br />Attachments: <br />A.
