Roseville Ethics Commission Minutes Meeting of July 8, 2002 Members Present: Chairman Mark Battis, Amy Ihlan, Richard Langseth and Thomas Ring Members Absent: Robert Kippley (excused, schedule conflict) Member Introductions: Chair Battis introduced himself and the other members introduced themselves. Review and Approval of Tonight’s Agenda: Chair Battis reviewed the agenda. Consider an Ethics Complaint Filed by Lillian Chiarella Against Mayor John Kysylyczyn, dated June 25, 2002: Battis reviewed several procedural matters. Specifically, he reviewed compliance with the procedures set forth in paragraph IV. B of the Roseville Ethics Procedures: this meeting was being held within 14 calendar days of receipt of the complaint, the ethics complaint dealt with a “public official,” the Mayor; the ethics complaint is signed, it states the Complainant believes the complaint to be true and it is not filed for frivolous reasons. As for the question of whether the behavior described in the complaint would if true be a violation of Roseville’s Ethics Code, Battis indicated that in fairness to the Respondent he believes that determination should not be made at this time. Then, with respect to procedural issues, Tom Ring stated he was recusing himself from this matter. Ring explained that his office, the Ramsey County Attorney’s Office, had reviewed a request seeking the filing of criminal felony charges against the Mayor for the same conduct described in the ethics complaint. Inasmuch as Ring had participated in a meeting at his Office discussing the filing of criminal charges relating to this conduct, he and the members of his Office believe it is best that he not participate in an ethics review of this matter. Battis indicated he might ask Ring and the Ramsey County Attorney’s Office to reconsider recusal if the Complainant and Respondent both agree that Ring could participate despite his Office’s criminal review of this matter.
