Regular City Council Meeting <br /> Monday,May 16,2011 <br /> Page 15 <br /> Roll Call(Original Motion as corrected) <br /> Ayes: McGehee; Johnson; and Willmus. <br /> Nays: Pust and Roe. <br /> Motion carried. <br /> Mayor Roe noted that a motion to publish a summary of the ordinance required a <br /> super-majority vote, based on statutory requirements. <br /> Johnson moved, McGehee seconded, enactment of Ordinance Summary No.1408 <br /> (Attachment C) for publication purposes entitled, "A Summary of an Ordinance <br /> Amending Title Three, Chapter 302.15 Civil Penalty Providing for Two Tier (Off <br /> Sale and On Sale) Suspension Penalties for Liquor License Violations." <br /> Councilmember Pust spoke in opposition to the motion based on the lack of a full <br /> community discussion, and her need that then the full ordinance should be pub- <br /> lished to make the public aware of the full content and action. <br /> Mayor Roe concurred, speaking in opposition to the motion to publish only a <br /> summary as well, noting that the full ordinance was not inordinately long. <br /> Public Comment <br /> John Kysylyczyn <br /> Mr. Kysylyczyn encouraged the City Council to vote for the motion for the public <br /> summary in an effort to save taxpayer monies; opining that the full ordinance <br /> would provide no additional public explanation; and suggested the actions be ex- <br /> plained in more detail in a future City newsletter or other means. <br /> City Attorney Gaughan <br /> At the request of Councilmember Willmus, City Attorney Gaughan advised that <br /> there was no legal requirement on how the publication was formatted, as long as <br /> the information passed was included. <br /> Councilmember Willmus noted that the City Council majority appeared to favor <br /> printing the entire ordinance. <br /> Roll Call <br /> Ayes: McGehee; Johnson; and Willmus. <br /> Nays: Pust and Roe. <br /> Motion failed (lacking the 4/5 super majority vote). <br /> Recess <br /> Mayor Roe recessed the meeting at approximately 8:18 p.m. and reconvened at approximately <br /> 8:22 p.m. <br />
