lt <br /> �-ARIN HILLS <br /> CITY OF ARDEN HILLS <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> RESOLUTION NO. 2013-009 <br /> A RESOLUTION AUTHORIZING THE ACQUISITION OF PROPERTY <br /> LOCATED AT 3151 LAKE JOHANNA BOULEVARD <br /> WHEREAS,the City of Arden Hills has entered into a Contract for Private Development <br /> with Presbyterian Homes of Arden Hills, Inc. (the "Developer") dated as of December 20, 2010 <br /> (the"Contract"); and <br /> WHEREAS, under the Contract, the Developer agreed to convey the property located at <br /> 3151 Lake Johanna Boulevard having a property identification number of 33-30-23-34-0013 and <br /> legally described as: <br /> That part of the south 305.00 feet of the Southwest Quarter of Section 33, Township 30, <br /> Range 23, Ramsey County, Minnesota, lying northeasterly of the center line of New <br /> Brighton Road; said center line running northwesterly at an angle of 63 degrees 37.5 <br /> minutes to the south line of said Southwest Quarter from a point 30.4 feet west of the <br /> southeast corner of said Southwest Quarter of Section 33. <br /> (referred to in the Contract as the "Triangle Parcel") to the City for a purchase price of <br /> $1.00, subject to certain terms and conditions; and <br /> WHEREAS, the City has now determined that Developer has carried out any <br /> Environmental Response Actions (as defined in the Contract) required for the Triangle Parcel, <br /> and that Developer has demolished the prior building on that parcel and cleared the parcel of <br /> rubble and debris, all as required under Section 3.5(e)(ii) and(iii) of the Contract; <br /> NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Arden <br /> Hills, Minnesota as follows: <br /> 1. City staff and consultants are authorized and directed to take all actions necessary <br /> to close on acquisition of the Triangle Parcel, subject to review and approval of <br /> title conditions by staff and consultants in accordance with Section 3.5 of the <br /> Contract; and subject to satisfaction of all other requirements of closing set forth <br /> in the Contract. <br /> 2. The Mayor and City Administrator are authorized and directed are authorized and <br /> directed to execute any documents required in order to close on the real estate <br /> transaction described in this Resolution. <br />
