<br />lit "'- - <br /> <br />STATE OF MINNESOTA <br /> <br />COUNTY OF RAMSEY <br />CITY OF ARDEN HILLS <br /> <br />-- <br /> <br />EESOLUTrON NO. 71/-J <br /> <br />EESOLUTION ESTABLISHING :POLICIES EE <br />LAND USE AND CONTROL MEASURES IN <br />FLOOD PLAIN AREAS <br /> <br />WHEREAS, the City of Arden Hills has heretofore adopted <br />and is enforcing its Building Code (Ord. No. 93, as amended) and <br />its Subdivision and Platting Ordinance (Ord. No. 98, as amended), <br />and <br /> <br />WHEREAS, Section 301(a) of the Uniform Building Code, <br />the terms and provisions of which are incorporated by reference <br />in Section 3 of Ord. No. 93, prohibits any person, firm or corpora- <br />tion from erecting, constructing, enlarging, altering, repairing, <br />improving, moving or demolishing any building or structure without <br />first obtaining a Building Permit for each building or structure <br />from the Building Inspector, and . <br /> <br />WHEREAS, Section 302(a) of the Uniform Building Code <br />provides that the Building Inspector must examine all plans and <br />specifications filed by the applicant prior to issuance of said <br />Building Permit, and <br /> <br />WHEREAS, Section 7(3) of Ord. No. 98, the platting and <br />Subdivision Ordinance, provides that no preliminary plan will be <br />approved for subdivision which covers an area subject to periodic <br />flooding or which contains extremely poor drainage facilities <br />unless the subdivider agrees to make improvements which will, in <br />the opinion of the City Engineer, make the area completely safe <br />for occupancy and provide adequate street and lot drainage, <br /> <br />. <br /> <br />NOW, THEREFORE, BE IT RESOLVED, by the City Council of <br />the City of Arden Hills as follows: <br /> <br />1. That the Building Inspector shall review all <br />Building Permit applications for new construction or substantial <br />improvements to determine whether proposed building sites will be <br />reasonably safe from flooding. If a proposed building site is in <br />a location that has a flood hazard, any proposed new construction <br />or substantial improvement (including pre-fabricated mobile homes) <br />must (Ube designed or modified and anchored to prevent flotation, <br />collapse, or lateral movement of the structure, (ii) use construc- <br />tion materials and utility equipment that are resistant to flood <br />damage and (iii) use construction methods and practices that will <br />minimize flood damage; and <br /> <br />2. That the City Engineer and City Planning Commission, <br />as mandated by Section CD) of Ord. No. 98, shall review all preliminary <br />plans of proposed subdivisions and determine whether (1) all such <br />preliminary plans are consistent with the need to minimize flood <br />damage, (ii) all public utilities and facilities, such as sewer, gas, <br />
