<br />, <br />. <br /> <br />. <br />.... <br /> <br />STATE OF MINNESOTA <br /> <br />COUNTY OF RAMSEY <br /> <br />CITY OF ARDEN HILLS <br /> <br />RESOLUTION No. 22=,1.6-- <br /> <br />. <br /> <br />RESOLUTION AUTHORIZING CITY ATTORNEY TO <br />COMMENCE CONDEMNATION PROCEEDING FOR <br />ACQUISITION OF A ROADWAY AND UTILITY <br />EASEMENT AND TO OBTAIN AN APPRAISAL IN <br />CONNECTION WITH THE KARTH LAKE - <br />WEST IMPROVEMENT <br /> <br />WHEREAS, at its meeting on November 11, 1978 the Arden <br />Hills City Council deemed the acquisition of a roadway and <br />utility easement, GO feet in width connecting Amble Road with <br />Nursery Hill Court in the proposed Karth Lake - . West <br />subdivision, to be both necessary and essential to the health, <br />safety and welfare of the residents of the City of Arden Hills <br />and authorized the City Engineer to prepare a legal description <br />of said strip of land, and <br /> <br />WHEREAS, after the City Engineer prepared said legal <br />description, representatives of the City have tried to no <br />avail to negotiate a purchase of said easement rights from the <br />owners of said strip of land, the City and the owners hot being <br />able to agree upon a price, and <br /> <br />WHEREAS, the public interest requires that said roadway <br />ELnd utility easement, to be perpetual in nature, be acquired <br />from the owners of said strip of land by means of the City's <br />eminent domain power, and <br /> <br />WHEREAS, the City Attorney needs an up-dated appraisal <br />to assist him in preparing the City's eminent domain case, <br /> <br />NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council <br />of the City of Arden Hills that the City Attorney is hereby <br />authorized and directed forthwith to commence an eminent domain <br />proceeding to acquire a perpetual roadway and utility easement <br />over and across the following described strip of land located <br />in the City of Arden Hills, County of Ramsey, and State of <br />Minnesota, to-wit: <br /> <br />. <br /> <br />The West sixty (GO) feet of the East four hundred <br />sixty-seven ELnd eleven one-hundredths (467.111 <br />feet of Lot 2 of Borstad Addition located in <br />Section 22, Township 30, Range 23. <br /> <br />BE IT FURTHER RESOLVED, that the City Attorney is hereby <br />authorized and directed to obtain an appraisal from Gordon <br />Elmquist & Associates, Inc. to assist him in the preparation of <br />the condemnation case. <br />
