<br />STATE OF MINNESOTA <br /> <br />COUNTY OF RAMSEY <br /> <br />CITY OF ARDEN HILLS <br /> <br />Resolution No. <br /> <br />cf'.4 _JY <br /> <br />. <br /> <br />RESOLUTION APPROVING FIRST AMENDMENT TO <br />LEXINGTON AVENUE & 1-694 DRAINAGE IMPROVEMENT <br />COST SHARING JOINT POWERS AGREEMENT <br /> <br />WHEREAS, the City Council's ordering the Grey Fox Road <br />Improvement Project (the "Road Project") eliminated an item in <br />the Lexington Avenue & 1-694 Drainage Project (the "Drainage <br />Project"). calling for the restoration of the existing portions of <br />Grey Fox Road after installation of the storm sewer along the <br />north side of Grey Fox Road, 37.8% of which--Le., $6,515.21-- <br />Shoreview had agreed to pay Arden Hills pursuant to Section <br />2(b) (2) of the Lexington Avenue & 1-694 Drainage Improvement Cost <br />Sharing Joint Powers Agreement (the "Agreement"), and <br /> <br />WHEREAS, unless the Agreement is amended clearly to <br />stipulate that Shoreview reimburse Arden Hills for $6,515.21 of <br />the Road Project costs, Shoreview would be reaping an unfair <br />benefit as a result of Arden Hills' shifting the restoration of <br />the Grey Fox Road portion of the Drainage Project to the Road <br />Project, and <br /> <br />WHEREAS, the City Attorney of Arden Hills has drafted a <br />document entitled "First Amendment to Lexington Avenue & 1-694 <br />Drainage Improvement Cost Sharing Joint Powers Agreement" (the <br />"First Amendment") which clarifies Shoreview's responsibility to <br />pay Arden Hills the sum of $6,515.21 of the Road Project costs, <br /> <br />NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council <br />of the City of Arden Hills that the First Amendment be and the <br />same hereby is approved and adopted in the form submitted. <br /> <br />BE IT FURTHER RESOLVED, that the Mayor and Clerk- <br />Administrator of the City be and they hereby are authorized to <br />sign the First Amendment on behalf of Arden Hills. <br /> <br />BE IT FURTHER RESOLVED, that the Clerk-Administrator be <br />and she hereby is authorized and directed to furnish a certified <br />copy of this Resolution as well as the original and copies of <br />the First Amendment to the appropriate officials of Shoreview and <br />to request that the Shoreview City Council adopt a Resolution <br />approving said First Amendment and authorizing its Mayor and City <br />tit Manager to sign the same on behalf of Shoreview. <br /> <br />Passed by the Arden Hills City Council this 8th day of <br />March, 1982. <br /> <br />~,~~~ <br /> <br />Attest: <br /> <br />~!W.~ <br /> <br />Charlotte McNiesh, <br />Clerk-Administrator <br />
