<br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />~ <br /> <br />CITY OF ARDEN HILLS <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION NO. 00-24 <br /> <br />RESOLUTION RELATING TO A MINOR SUBDIVISION FOR THE <br />ARDEN MANOR PARK PROPERTY <br /> <br />WHEREAS, by document dated July 2, 1979,550 Associates conveyed a public recreational <br />easement to the City of Arden Hills ("City") over certain property described on the Deed of <br />Conveyance ("Arden Manor Park Property") attached as Exhibit A; and <br /> <br />WHEREAS, by document dated September 13, 1999, the City agreed to construct certain <br />stormwater drainage improvements beneficial to other property owned by 550 Associates <br />adjacent to the Arden Manor Park Property and 550 Associates agreed to convey fee title to the <br />Arden Manor Park Property to the City; and <br /> <br />WHEREAS, the City Council finds that the following special circumstances apply to the Arden <br />Manor Park Property: <br /> <br />A. The legal description for the property was effectively created twenty (20) years <br />ago when the City accepted the conveyance of the permanent recreational <br />easement. <br /> <br />B. The property has been used as a park for approximately twenty (20) years and is <br />clearly defined in relationship to surrounding property. <br /> <br />C. The City signed an agreement to purchase the property by use of a meets and <br />bounds description subject to future platting of the property. <br /> <br />WHEREAS, the conveyance of the Arden Manor Park Property will effectively result in a minor <br />subdivision of a larger parcel of property that normally requires Planning Commission review <br />unless the City Council varies the provisions of its subdivision regulations. <br /> <br />NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Arden Hills, <br />Minnesota that: <br /> <br />A. The provision of the City subdivision regulations that require Planning <br />Commission review of minor subdivisions is waived; <br />
