<br />CITY OF ARDEN HILLS <br />RAMSEY COUNTY, MINNESOTA <br /> <br />- <br /> <br />RESOLUTION NO. 94-11 <br /> <br />A RESOLUTION ADOPTING A HEALTH CARE AND DAYCARE <br />EXPENSE REIMBURSEMENT PLAN AND ADMINISTRATIVE <br />SERVICES CONTRACT WITH DCA, INC. <br /> <br />WHEREAS, the City Council of the City of Arden Hills considered <br />a proposal to provide a Flexible Benefits Program to <br />the City's employees thus providing the City and <br />employees with certain tax advantages; and <br /> <br />WHEREAS, the City Council approved adoption of this Flexible <br />Benefits Program and approved entering into an <br />Administrative Agreement with DCA, Inc, at its <br />November 8, 1993 City Council Meeting; and <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City <br />of Arden Hills, Minnesota that the City is authorized to make <br />such contributions from the funds of the City as are necessary <br />to carry out the provisions of said plan at any time, and <br /> <br />. <br /> <br />BE IT FURTHER RESOLVED in the event any conflict arises between <br />the provisions of said plan and the Employees Retirement Income <br />Security Act of 1974 (ERISA) or any other applicable law or <br />regulation (as such law or regulation may be interpreted or <br />amended), the employer shall resolve such conflict in a manner <br />which complies with ERISA or such law or re ulation, <br /> <br /> <br />ICIC-- <br /> <br />PASSED AND ADOPTED BY THE CITY COUNCIL <br />HILLS THIS 31ST DAY OF JANUARY, 1994. <br /> <br />THO <br /> <br /> <br />ATTEST: <br /> <br />DOR <br /> <br /> <br />~ <br /> <br />ON, CITY ADMINISTRATOR <br /> <br />~ <br />
