<br />~ <br />~HILLS <br /> <br />MEMORANDUM <br /> <br /> <br />DATE: March 3, 2008 <br /> <br />TO: Mayor and City Council <br />FROM: Jim Willis, Interim City Administrato~ <br /> <br />SUBJECT: Majority voting when three Council members are present <br /> <br />I presented the Council with a brief memo on this topic at your February 19 meeting. The <br />Council requested that I draft a policy to address the issue when only three members are present <br />and voting, specifically when an important and/or controversial issue is to be voted upon. <br /> <br />Your present Code provides in Section 2l0.04, Rules and Procedures, Subd. 5, Voting Generally, <br />the following language: <br /> <br />" Except as otherwise provided in this Code, or when a different vote is required by law, <br />a majority vote of those present shall be sufficient to approve any question posed to the <br />Council. " [emphasis added] <br /> <br />Based upon your comments at the February 19 meeting, the Council may wish to consider an <br />administrative policy that provides essentially the following: <br /> <br />"In the event that only three Council members are present and voting on a question <br />before the Council and providing that the question is deemed by at least one Council <br />member to be important and/or significant in terms policy implications, the question will <br />be deferred to the next Council meeting. " <br />
