RESOLUTION 13 -006� <br /> A RESOLUTION ORDERING PUBLIC HEARING TO AMEND SPECIAL <br /> ASSESSMENT ON IMPROVEMENT <br /> WHEREAS, on June 10, 2009, the City Council Adopted Resolution Number 09 -015 <br /> approving special assessments on the improvement of 21 Avenue from a point <br /> approximately 600 feet south of Main Street to a point approximately 1,400 feet south of <br /> Main Street and continuing on a new unnamed street (now Commerce Drive) parallel to <br /> Main Street westerly to 20th Avenue, by installation of watermain, sanitary sewer, street <br /> pavement, curb, storm sewer and related drainage improvements, and <br /> WHEREAS, one of the assessed property owners filed an appeal of such assessments and <br /> ultimately obtained relief from the Courts, and <br /> WHEREAS, the Court affirmed the public purpose and benefit of improvements to the <br /> affected parcel but ordered a reassessment of the amount of benefit to the affected parcel <br /> in an amount not to exceed $249,000. <br /> WHEREAS, the city engaged the services of a professional appraiser to determine the <br /> improvement in value as a result of the improvement, and in accordance with direction of <br /> the Court, and <br /> WHEREAS, such professional appraiser determined that the increase in value to the <br /> subject property as a result of the improvement is at least $249,000, and <br /> WHEREAS, it is proposed to amend such special assessment against the subject parcel to <br /> the amount of $249,000. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br /> CENTERVILLE, MINNESOTA, <br /> 1. A hearing shall be held on the 13th day of February, 2013, at City Hall, at 6:30 <br /> p.m. to pass upon the proposed reassessment and at such time and place all persons <br /> owning property affected by such improvement will be given an opportunity to be heard <br /> with reference to such reassessment. <br /> 2. The City Administrator is hereby directed to cause a notice of the hearing on the <br /> proposed assessment to be published once in the official newspaper at least two weeks <br /> prior to the hearing and he shall state in the notice the total cost of the improvement. He <br /> shall also cause mailed notice to be given to the owner of each parcel described in the <br /> assessment roll not less than two weeks prior to the hearing. <br />
