EXTRACT OF MINUTES OF MEETING OF CITY COUNCIL CITY OF ROSEVILLE RAMSEY COUNTY, MINNESOTA Pursuant to due call and notice thereof, the City Council of the City of Roseville, County of Ramsey, State of Minnesota met in regular session at the City Hall on Monday, the fourteenth day of April, 1997, at 6:30 o'clock p.m. The following members were present: Wiski, Maschka, Mastel, Goedeke, and Wall and the following were absent: None. Councilperson Goedeke introduced and moved the adoption of the following resolution: RESOLUTION NO. 9403 A RESOLUTION DETERMINING TO ACQUIRE BY CONDEMNATION UNDER THE POWER OF EMINENT DOMAIN CERTAIN EASEMENTS FOR UTILITY PURPOSES, AND TEMPORARY CONSTRUCTION, AND DIRECTING THE NECESSARY PROCEEDINGS BE INSTITUTED BY THE CITY ATTORNEY FOR SUCH PURPOSE. WHEREAS, the City Council for the City ofRoseville has approved a project to acquire certain property by reason of construction of utilities, said improvement identified by City records as Improvement No. 94-07; and WHEREAS, the City Council has been advised by competent advisers that the following described real property is necessary for the construction of the roadway. WHEREAS, the City has been unable to agree on a negotiated amount for some of the easements to be acquired; and WHEREAS, under Minn. Stat. 412.211 and Minn. Stat. Ch. 117, the City has the power to take and acquire easements by way of eminent domain; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ROSEVILLE, MINNESOTA, AS FOLLOWS: The City Council of the City of Rose vi lie hereby deems it necessary and convenient that perpetual and temporary construction easements on the properties described in Exhibit A attached as a part of this resolution be acquired by the City ofRoseville for the purposes above described. Further, that the City Attorney be and hereby is instructed to commence the necessary proceedings in condemnation under the power of eminent domain the name and in behalf of the City to acquire such easements. Further, because construction is scheduled to commence in mid- 1997, the City Attorney is further directed to use the "quick take" procedure under Minn. Stat. 117.042.
