<br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 20th day of June, 2005, at 6:00 p.m. <br /> <br />The following members were present: Kough, Thlan, Schroeder, Maschka, and Klausing <br />and the following were absent: None <br /> <br />Council Member Schroeder introduced the following resolution and moved its adoption: <br /> <br />RESOLUTION NO. 10318 <br /> <br />A RESOLUTION APPROVING THE VACATION OF CERTAIN PUBLIC RIGHTS-OF- <br />WAY AND EASEMENTS ON PROPERTY WITHIN TWIN LAKES PHASE 1 <br />(PF3595 AND 3645). <br /> <br />WHEREAS, Master Developer Rottlund Companies has requested the vacation of certain <br />public rights-of-way, road and utility easements that lie within the Twin Lakes Phase 1 area; and <br />these easements are illustrated in attachment A and legally described in attachment B, and <br /> <br />WHEREAS, the requested right-of-way and easements are located on the following <br />addressed properties: <br /> <br />Property Identification Number <br />04-29-23-32-0001, 0002, 0003, 0007, and 0012; <br />04-29-23-33-0003, 0010, and 0011; <br />04-29-23-34-0001, 0028, and 0032 <br /> <br />WHEREAS, the Public Works Department has determined that the requested road rights- <br />of-way, roadway easements, and utility easements are no longer necessary for public <br />infrastructure; and <br /> <br />WHEREAS, the Roseville Plmming Commission held a public hearing regarding the <br />Right-of- Way, Roadway Easement and Utility Easement vacation requested by Master Developer <br />Rottlund Companies and voted (6-0) to recommend approval of the vacation, based on the <br />findings of Section 5.17 - 5.22 and the condition of Section 6 of the project report dated June 1, <br />2005. <br /> <br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to grant the <br />VACATION of celiain PUBLIC RIGHTS-OF-WAY and EASEMENTS on the above identified <br />properties, based on the findings in Section 5 of the project repOli dated June 20,2005, and <br />subject to the following conditions: <br /> <br />1. The applicant must submit the legal description of the area to be vacated and the <br />proper legal document on which to record the vacation at Ramsey County, both to <br />be reviewed and approved by the Director of Public Works (Attached). <br /> <br />1 <br />
