<br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City <br />of Roseville, County of Ramsey, Milmesota, was duly held at the City Hall on Monday, the 24th <br />day of July 2006 at 6:00 p.m. <br /> <br />The following members were present: Maschka, Pust, Ihlan and Mayor Klausing <br />and the following were absent: Kough <br /> <br />Council Member Pust introduced the following resolution and moved its adoption: <br /> <br />RESOLUTION NO. 10419 <br /> <br />A RESOLUTION APPROVING A CONDITIONAL USE PERMIT TO ALLOW A <br />DRIVE-THRU WINDOW AT BEATNIK'S COFFEE, <br />1724 LEXINGTON AVENUE (PF3772) <br /> <br />LEGAL DESCRIPTION: <br />PART SOUTH OF MEMORIAL ADDITION NO.1 OF THE WEST QUARTER OF <br />THE SOUTHWEST QUARTER OF SOUTHWEST QUARTER OF <br />SECTION 14, TOWNSHIP 29 NORTH, RANGE 23 WEST, <br />SUBJECT TO ROADS & EASEMENTS <br /> <br />WHEREAS, Sky Johnson, owner of Beatnik's Coffee seeks use ofan existing driveOthru <br />window foe his business; and <br /> <br />WHEREAS, a coffee shop with drive-thru facilities is considered a RESTAURANT, <br />CLASS II FAST FOOD CONVENIENCE that requires a CONDITIONAL USE PERMIT ofr <br />the drive-thm facility; and <br /> <br />WHEREAS, the Planning Commission held the public hearing on July 12,2006, <br />recommending approval (5-0) of the request, subject to specific conditions; and <br /> <br />NOW THEREFORE BE IT RESOLVED by the City Council (the "Council") of the City <br />of Roseville, (the "City"), Ramsey County, Mirmesota, to approve the application of Sky <br />Johnson (Beatnik's Coffee) for a CONDITIONAL USE PERMIT to allow a drive-thru at 1724 <br />Lexington A venue subject to the following conditions: <br /> <br />1. The use of the site as proposed will have a minimal impact on traffic in the area, as the use of the <br />property wi II not be changing. <br /> <br />2. The use of the property as proposed will not have an impact on parks, streets and other public <br />facilities. <br /> <br />3. The use of the property as proposed will be compatible with contiguous properties. The site will <br />be upgraded, with a screen fence for the Irash dumpster. <br />
