<br />City of <br /> <br />~~~ <br /> <br />Executive Session of the City Council <br />Minutes <br />Roseville City Hall Council Chambers <br />Monday, January 22, 2007 <br /> <br />Present: (Voting and Seating Order) Councilmembers Roe; Kough; Pust; <br />Ihlan; and Mayor Klausing. Also present: City Attorneys Scott Anderson, <br />Jim Casserly and City Attorney Paul Reuvers from the League of Minnesota <br />Cities Insurance Trust (LMCIT); City Manager Bill Malinen; and <br />Community Development Director John Stark. <br /> <br />Executive Session of the City Council <br />The City Council met at 6:00 p.m. in the Aspen Room at City Hall for the <br />purpose of discussing Twin Lakes Litigation. <br /> <br />Recess <br /> <br />Reconvene <br />Mayor Klausing reconvened in Open City Council Study Session in the City <br />Hall Council Chambers at approximately 6:43 p.m. <br /> <br />At the request of Mayor Klausing, City Attorney Anderson briefly <br />summarized, pursuant to State Statutes l3D.Ol and l3D.05, the grounds <br />permitting a closed meeting under client/attorney privilege, to allow the City <br />to have private communication on pending and threatened litigation. Mr. <br />Anderson noted that the Closed Executive Session held earlier this evening <br />was to receive additional information and hear a status report from City <br />Attorney Reuvers from the League of Minnesota Cities Insurance Trust <br />(LMCIT), and to discuss strategy and tactics, related to pending litigation <br />between Roseville Twin Lakes, LLC and the City of Roseville. <br /> <br />A brief synopsis of the lawsuit was given by City Attorney Anderson, at the <br />request of Councilmember Ihlan, indicating that Roseville Twin Lakes, LLC <br />was pursuing a temporary restraining order halting the City's calling in of <br />the developer's letter of credit, disputing differing theories and obligations <br />of each party at this time. <br />
