<br />EXTRACT OF MINUTES <br />OF MEETING OF THE CITY COUNCIL <br />OF THE CITY OF ROSEVILLE <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was duly held on the 25th day of October 1999, at 6:30 <br />p.m. <br /> <br />The following members were present: Wiski, Maschka, Mastel, Goedeke, Wall <br />and the following were absent: None <br /> <br />Council Member Wiski introduced the following resolution and moved its adoption: <br /> <br />Resolution No. 9701 <br />Resolution Approving a Shoreland Setback Variance <br />at 1281 Josephine Road <br /> <br />WHEREAS, Section 1016.16A ofthe Roseville Zoning Ordinance requires structures (new <br />buildings and decks) to have a minimum setback of 75 feet from Shoreline; and <br /> <br />WHEREAS, the definition of shoreline is the Ordinary High Watermark or OHW; and <br /> <br />WHEREAS, the original non-conforming house was setback 37 feet from the shoreline and <br />the kitchen addition setback 26 feet 6 inches from the shoreline; and <br /> <br />WHEREAS, Section 1016.22B of the Roseville Zoning Ordinance states that additions or <br />expansions to non-conforming structures must meet the height, setback, and other requirements <br />of the City Code, unless authorized by a variance; and <br /> <br />WHEREAS, Section 1016.22C of the Roseville Zoning Ordinance states that deck <br />expansions on non-conforming structures may be allowed if: the house was built prior to March <br />27, 1974; no reasonable alternative deck location could be found; and, the proposed deck <br />extension would not exceed 15% of the existing structure setback from the lake or be closer than <br />30 feet, whichever is the greater setback; and <br /> <br />WHEREAS, Mr. Kadrie's request is for a three (3) foot wide encroachment (maintenance <br />deck) to a point 23 feet 6 inches from the original shoreline; and <br /> <br />WHEREAS, the Roseville Planning Commission conducted a public hearing on the <br />request on Wednesday, October 13,1999, and recommended (7-0) approval of the requested <br />variance, subject to the removal of any deck improvement currently existing on the property that <br />encroaches closer to the shoreline that 23 feet 6 inches. (29 feet 6 inches from the repaired <br />shoreline); and <br /> <br />WHEREAS, the Roseville City Council received the Planning Commission's <br />Page 1 of3 <br />
