Stat. ~ 115B.178 that certain actions <br />proposed to be taken by Accessible Space, Inc. (AS!) at the Roselawn Village, located at the address <br />referenced above (the Site), will not constitute conduct associating ASI with the release or threatened release <br />of hazardous substances, pollutants, or contaminants at the Site for the purpose of Minn. Stat ~ 115B.03, subd. <br />3(4) (2000). <br /> <br />The Minnesota Pollution Control Agency (MPCA) staff in the Voluntary Investigation and Cleanup (VIe) Unit <br />has reviewed the documents submitted for the Site (Site Documents). ASI has purchased the Site and proposes <br />to construct a multi-family apartment complex fmanced by the Department of Housing and Urban <br />Development (HUD). HUD has requested assurance letters from the MPCA regarding the proposed <br />development. A Phase I and Phase II Investigation was conducted at the Site by EnPro Assessment. <br />Historically, the past Site activities have included agricultural and residential uses. A Phase II Investigation <br />was conducted involving the advancement of three soil borings; ground water samples were collected from two <br />of the borings, SB-ll and SB-12, located along the west-southwestern edge of the Site. Ground water samples <br />identified the presence of the volatile organic compounds I, I-trichloroethane, trichloroethane, trichloroethene <br />and chloromethane. Elsewhere at the Site a small oil stained area containing diesel range organic <br />contamination (DRO) was identified. This oil stained DRO contamination has since been excavated and <br />disposed of properly offsite. These VOCs detected in these two borings in the ground water and the DRO <br />release in the shallow soil constitute the identified release for the purposes of this letter (the Identified <br />Release). <br /> <br />Based upon a review of the information provided to the MPCA VIC Program, and subject to the conditions set <br />forth in this letter, a determination is hereby made pursuant to Minn. Stat. ~ 115B.l 78, subd. 1 that the <br />proposed actions (Proposed Actions) as described in a letter from Dan Billmark of ASI to Patrice Jensen of the <br />MPCA, dated August 29,2002 (the Letter) will not associate ASI with the Identified Release for the purpose <br />of Minn. Stat. ~ 115B.03, subd. 3(4) (2000). The Proposed Actions for which this determination applies <br />include the following: <br /> <br />· Construction of a multi-family apartment project financed by HUD under its Section 811 program. <br /> <br />520 Lafayette Rd.
