<br />EXTRACT OF MINUTES OF MEETING <br />OF CITY COUNCIL <br />OF CITY OF ROSEVILLE <br />RAMSEY COUNTY, MINNESOTA <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, <br />Minnesota, was held in the City Hall in said City on Monday, August 12,2002 at 7:00 o'clock p.m. <br /> <br />The following members were present: Klausing, Schroeder, Maschka, and Kough and the following <br />were absent: Kysylyczyn. <br /> <br />Councilmember Schroeder introduced the following resolution and moved its adoption: <br /> <br />RESOLUTION 10019 <br /> <br />RESOLUTION APPROVING A LIMITED USE PERMIT <br />AGREEMENT BETWEEN MN/DOT AND THE CITY OF ROSEVILLE <br />TO OPERATE AND MAINTAIN THE RICE STREET SIDEWALK <br />WITHIN MN/DOT RIGHT-OF-WAY <br /> <br />WHEREAS, the City of Roseville, Minnesota, is constructing a sidewalk along Rice Street from <br />Minnesota Street to County Road B; <br /> <br />AND WHEREAS, Rice Street intersects Trunk Highway No. 36 right-of-way; <br /> <br />AND WHEREAS, Mn/DOT requires the City of Roseville to acquire a Limited Use Permit in order <br />to construct, operate, and maintain the pathway within Mn/ DOT right-of-way; <br /> <br />THEREFORE BE IT RESOLVED by the City Council of the City ofRoseville, Minnesota, that the <br />Mayor and the City Manager are hereby authorized and directed for and on behalf of the City to <br />execute and enter into an agreement with the State of Minnesota Department of Transportation <br />prescribing the terms and conditions of said Limited Use Permit as set forth and contained in <br />"Minnesota Department of Transportation Limited Use Permit", a copy of which said agreement was <br />before the City Council and which is made a part hereof by reference. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Member Kough upon <br />a vote being taken thereon, the following voted in favor thereof: Maschka, Schroeder, Kough and <br />Klausing, and the following voted against the same: none. <br /> <br />WHEREUPON said resolution was declared duly passed and adopted. <br />
