EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF ROSEVILLE * * * * * * * * * * * * * * * * * Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville,County of Ramsey,Minnesota was duly held on the 17th day of June 2019, at 6:00 p.m. The following members were present: Laliberte,Etten,Willmus, Groff,and Mayor Roe. and the following were absent: None Member Etten introduced the following resolution and moved its adoption: RESOLUTION No. 11610 RESOLUTION APPROVING A VARIANCE FROM CITY CODE SECTION 405.03, HOURLY RESTRICTIONS ON CERTAIN OPERATIONS FOR ROSEVILLE CENTER, 1121-1151 LARPENTEUR AVE. WHEREAS, TMG Construction, Inc.,has requested a variance from City Code Section 405.03.D. Construction Activities, which requires construction activities to occur between the hours of 7:00 a.m. and 9:00 p.m. on any weekday, or between hours of 9:00 a.m. and 9:00 p.m.on any weekend or legal holidays; and WHEREAS, TMG Construction,Inc.,will perform a replacement of existing concrete entryways and sidewalks at the Roseville Center,and has requested a variance to the City Code for the following dates and time: during the period of June 25-July 9, 2019, from 9:00 p.m. - 7:00 a.m. The project is expected to take one to five days to complete,subject to good weather and other unforeseen delays; and WHEREAS, TMG Construction is requesting this variance for safety reasons. Avoiding heavy construction activities during the hours that the shopping center is open will reduce the inconvenience to the public and maintain a safe passage in and out of the tenant spaces; NOW, THEREFORE, BE IT RESOLVED, that by the City Council of the City of Roseville, Minnesota, that the variance from City Code Section 405.03, Hourly Restrictions on Certain Operations for Roseville Center, 1121-1151 Larpenteur Ave., is hereby approved, subject to the following conditions: 1) The variance hours shall only extend to 11pm. 2) No jackhammering or loading of concrete or bituminous into trucks is permitted during the variance hours.
