<br />EXTRACT OF MINUTES OF MEETING OF THE <br /> <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City <br />Council of the City of Roseville, County of Ramsey, Minnesota was duly <br />held on the 14th day of October, 1991, at 7:30 p.m. <br /> <br />The following members were present: Thomas, Johnson, Cushman, Maschka, <br />and Rog, and the following were absent: None. <br /> <br />Member Cushman introduced the following resolution and moved its <br />adoption: <br /> <br />RESOLUTION NO. 8713 <br /> <br />FRANK REKUSKI MINOR VARIANCE <br /> <br />WHEREAS, there is presently a judgment in the District Court of the <br />State of Minnesota; venued in Ramsey County, requiring the house at <br />1225 Josephine Road to be moved approximately two feet; and <br /> <br />WHEREAS, this judgment has been sustained in the Appellate Courts and <br />is identified by the following Court File Numbers: <br /> <br />Ramsey County Court File No. C6-89-5680, <br />Court of Appeals File No. C4-90-1024, <br />Minnesota Supreme Court File No. C4-90-1024; <br /> <br />and <br /> <br />WHEREAS, an agreement has been entered into between the property <br />owners involved; and <br /> <br />WHEREAS, an application for a minor variance has been filed by Frank <br />Rekuski for the property at 1225 Josephine Road; <br /> <br />NOW, THEREFORE, BE IT RESOLVED, that: <br /> <br />1. The minor variance requested by Frank Rekuski is granted, allowing <br />the house at 1225 Josephine Road to remain in its present loca- <br />tion. <br /> <br />2. The variance is granted on the following condition: <br /> <br />That Frank Rekuski comply with all of the requirements on <br />the Agreement which is marked as Exhibit "A" and attached <br />hereto and made a part hereof. <br /> <br />3. In the event that Frank Rekuski does not comply with all of the <br />conditions, this minor variance will be null and void. <br /> <br />4. The City Attorney will be advised to dismiss the litigation upon <br />being informed by the City Building Department and Vaughn Larson <br />that all conditions of the Agreement have been met. <br />
