Call to Order <br />Acting Chair Daniel Boerigter called to order the Variance Board meeting at 5:04 p.m. and <br />reviewed the role and purpose of the Variance Board. <br /> <br />2. Roll Call & Introductions <br />City Planner Thomas Paschke called the Roll <br /> <br />Members Present: Acting Chair Boerigter; and Commissioners Jim Doherty and Joe Wozniak. <br /> <br />Staff present: City Planner Thomas Paschke; Community Development Director John Stark; <br />GIS Technician Joel Koepp; Associate Planner Bryan Lloyd; and City Engineer Debra Bloom. <br /> <br />3. Approval of Minutes <br /> <br />MOTION <br />Member Doherty moved, seconded by Member Wozniak, to approve meeting minutes of <br />April 4, 2007 as presented. <br /> <br />Ayes: 3 <br />Nays: 0 <br />Motion carried. <br /> <br />Public Comments <br />Acting Chair Boerigter called for any public comment on any non-agenda items. No one <br />appeared to speak. <br /> <br />4. Public Hearings <br /> <br />a. PLANNING FILE 07-012 <br />VARIANCE to <br />Request by Gold Eagle Laundry, 1233 Larpenteur Avenue, for a <br />Roseville City Code,§1005 (Business Districts) <br /> to allow a parking area drive aisle <br />encroachment into a required side yard setback. <br /> <br />Acting Chair Boerigter opened the Public Hearing for Planning File 07-012. <br /> <br />Associate Planner Bryan Lloyd provided a bench handout consisting of a revised <br />DRAFT resolution, incorporating an additional condition related to an encroachment <br />“[ <br />agreement. The condition, number 6, read, An encroachment agreement must <br />be signed by the applicant to release the City from any financial liability of the <br />parts o the retaining wall encroaching into the sanitary sewer easement were to <br />]” <br />be damaged while working within the easement. <br /> <br />Mr. Lloyd reviewed the request to allow site improvements and parking area <br />modifications, including a drive lane that would encroach five feet (5’) into the required <br />five foot (5’) setback at 1233 Larpenteur Avenue, as detailed on the staff report dated <br />May 2, 2007. Mr. Lloyd noted that a continuous asphalt paved lot from one lot to the <br />next with neighboring properties is an existing, nonconforming condition, and a cross- <br />access agreement exists between these adjacent property owners allowing <br />unrestricted circulation between the properties as well as access to Fernwood <br />Avenue, Mr. Lloyd further noted that another nonconforming condition, a fourteen foot <br />(14’) setback from the Larpenteur Avenue right-of-way, existed in the parking area,. <br /> <br />
