<br /> <br />Variance Board Meeting <br />City Council Chambers, 2660 Civic Center Drive <br />Minutes - Wednesday, August 01, 2007 <br />1. Call to Order <br />Vice Chair Jim Doherty called to order the Variance Board meeting at 5:00 p.m. and reviewed <br />the role and purpose of the Variance Board. <br />2. Roll Call & Introductions <br />City Planner Thomas Paschke called the Roll. <br />Members Present: Vice Chair Jim Doherty and Commissioners Barbara Martinson and <br />Thomas Gottfried. <br />Member Absent: Chair Daniel Boerigter. <br />Staff present: City Planner Thomas Paschke; Associate Planner Bryan Lloyd; and Mike <br />Darrow, Short Elliott Hendrickson, Inc. (S.E.H. Planning), Interim Community Development <br />Director, City of Roseville. <br />3. Approval of Minutes <br />MOTION <br />Member Martinson moved, seconded by Member Doherty, to approve meeting minutes <br />of July 11, 2007 as presented. <br />Ayes: 2 <br />Nays: 0 <br />Abstentions: 1 (Gottfried) <br />Motion carried. <br />4. Public Hearings <br />a. PLANNING FILE 07-043 <br />Request by Santos Escobar, 175 Burke Avenue, for a VARIANCE to Roseville <br />City Code, §905 (Swimming Pools) to allow a swimming pool to encroach into <br />the required setbacks from the side and rear property lines. <br />Vice Chair Doherty opened the Public Hearing for Planning File 07-043. <br />Associate Planner Bryan Lloyd reviewed the request of Mr. Escobar for installation of <br />an above-ground pool at 175 Burke Avenue, with the proposed pool encroaching five <br />feet (5’) into the required ten foot (10’) setback from side and rear property lines. <br />Mr. Lloyd noted that the property had two (2) major utility easements: one in the front <br />yard for a water main and one in the rear/side yard for sanitary sewer. Mr. Lloyd <br />advised that decks and gazebos are not permitted within utility easements without a <br />signed “encroachment agreement.” Mr. Lloyd further noted that the existing attached <br />deck and gazebo were constructed within the sanitary sewer easement; however, the <br />Public Works Department has no such document on file. Staff, therefore, <br />recommends that it would be reasonable to allow the pool and decking to be built over <br />and have footings within the utility easement if the applicant were to enter into an <br />encroachment agreement. <br />VARIANCE to Roseville City <br />Staff recommended APPROVAL of a five foot (5’) <br />Code,§905 (Swimming Pool Location) <br /> to allow the installation of a pool in the <br />proposed location; based on the comments and findings of Section 5 and the <br />conditions of Section 6 of the project report dated August 2, 1007. <br /> <br />
