City of <br />1~~ <br />Minnesota, USA <br />Executive Session of the City Council <br />Minutes <br />City Hall Council Chambers, 2660 Civic Center Drive <br />Monday, March 17, 2008 <br />1. Call Roll <br />While in Open Session, City Attorney Anderson advised the City Council that legal mat- <br />ters had come up quickly, on which he needed to discuss with the Council, justifying and <br />demanding client/attorney discussions related to pending litigation matters. Mr. Ander- <br />son advised that two such litigation matters were currently pending, and according to <br />Minnesota Statute Section 13D.05 of the Open Meeting Law, closure was permitted un- <br />der the attorney/client privilege. Mr. Anderson advised that the discussion would pertain <br />to his conversation earlier today with the City of Arden Hills City Attorney regarding the <br />recently filed lawsuit against the City and the City of Arden Hills by Flaherty's Bowl; <br />and that the topic would pertain to the status and handling of that matter. The other mat- <br />ter pertained to the Davanni's Liquor License suspension hearing, and Mr. Anderson <br />needed to provide a status report to the City Council on the matter and discuss matters <br />pertaining to communications with Davanni's. <br />Pust moved, Ihlan seconded, that the meeting be closed, with the Council voting 4-0 to <br />close the meeting. Mayor Klausing convened the Roseville City Council in executive ses- <br />sion and called the meeting to order at approximately 6:30 p.m. <br />Councilmembers present were: Councilmember Pust; Ihlan; Roe; and Mayor Klausing. <br />City Attorney Scott Anderson was also present. <br />Staff present included City Manager Malinen; Police Chief Carol Sletner; Public Works <br />Director Duane Schwartz; and City Engineer Deb Bloom. <br />2. Executive Session <br />In accordance with Minnesota Statute Section 13D.05, the City Council and staff dis- <br />cussed attorney/client privileged information related to the recently filed lawsuit against <br />the City and the City of Arden Hills by Flaherty's Bowl, and the Davanni's Liquor Li- <br />cense suspension hearing. <br />3. Adjourn <br />Mayor Klausing adjourned the executive session at approximately 6:45 p.m., and the City <br />Council reconvened in open session shortly thereafter resuming the Regular Meeting <br />business agenda. <br />(See separate Regular Meeting minutes.) <br />
