EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 18~' day of May 2009 at 6:00 p.m. <br />The following members were present: Roe, Johnson, Ihlan, Pust, and Mayor Klausing <br />and the following were absent: none <br />Council Member Johnson introduced the following resolution and moved its adoption: <br />RESOLUTION NO.10708 <br />A RESOLUTION APPROVING THE VACATION OF CERTAIN PUBLIC RIGHT-OF- <br />WAY ON PROPERTY LOCATED AT 2750 CLEVELAND AVENUE (PF09-012) <br />WHEREAS, Old Dominion Freight Line, Inc. has requested the VACATION of <br />CERTAIN PUBLIC RIGHT-OF-WAY that lie on their property located at 2750 Cleveland <br />Avenue and pursuant to the Vacation and Rededication Agreement dated December 15, 2008; <br />and <br />WHEREAS, the Public Works Department has determined that the existing right-of--way <br />can be vacated pursuant to the Vacation and Rededication Agreement; and <br />WHEREAS, said following PUBLIC EASEMENTS are to be vacated in their entirety: <br />The Northerly Ten (10) feet and Easterly Ten (10) feet of Outlot A, Twin Lakes Addition, <br />according to the recorded plat thereof, Ramsey County, Minnesota. <br />WHEREAS, on May 6, 2009, the Roseville Planning Commission held the duly noticed <br />public hearing regarding the PUBLIC RIGHT-OF-WAY VACATIONS and voted (6-0) to <br />recommend approval of based on the information contained in the project report dated May 6, <br />2009; <br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to grant the <br />VACATION of certain PUBLIC RIGHT-OF-WAYS on property addressed at 2750 Cleveland <br />Avenue. <br />The motion for the adoption of the foregoing resolution was duly seconded by Council <br />Member Roe, and upon vote being taken thereon, the following voted in favor: Roe, Johnson, <br />Ihlan, Pust, and Mayor Klausing <br />and the following voted against: none <br />WHEREUPON said resolution was declared duly passed and adopted. <br />
