meet the City's requirement, Staff is recommending that an additional ten caliper inches of <br />trees be planted as part of a condition of approval of this application. <br />B. Lighting Section 1325.05 Subd. 3 Meets Requirements <br />A photometric plan has been submitted and indicates that the proposed lighting meets the <br />requirements of the Zoning Code. The type of lighting to be used has not been submitted; <br />however, it will be required to meet the requirements of the Code in order for building <br />permits to be issued. <br />C. Screening Section 1325.05 Subd. 4 Meets Requirements <br />All parking, loading, garbage containers, and mechanical operating equipment are required to <br />be screened from view of adjacent public rights of way. Based on a review of the site plan <br />and landscaping plan it appears that this requirement will be met. Staff would recommend <br />that the City reserve the right to require additional screening materials in the event that this <br />requirement is not fulfilled by the proposed plan. <br />D. Parking Section 1325.06 Meets Requirements <br />The City Code requires one parking stall for every two seats. The proposed restaurant would <br />have 85 seats, equating to 43 required parking stalls. The proposed plan indicates 44 parking <br />stalls. <br />2. Design Standards Section 1325.05 Subd. 8 <br />While the proposed application is in substantial conformance with the intent and letter of the <br />design standards, the items that the applicant is requesting flexibility are listed below: <br />Building Design Flexibility Requested <br />At least fifty percent (50 of the largest building on each site is required to be constructed <br />at the front setback line. As discussed previously, the building would be setback <br />approximately 48 feet from the front property line, when 20 feet is required. The location of <br />the drive -thru aisle and the steep shift in grade towards County Road E prevents the building <br />from being located any farther to the south. <br />Commercial Facade Transparency Flexibility Requested <br />At least 50 percent of the front elevation that includes the front entrance or faces a public <br />street shall be comprised of transparent glass.
