Proposed Zoning Code Amendment <br />The applicant is proposing amendments to Section 1325.01 of the Zoning Code, which deals <br />with accessory structures. Currently, in R -1, R -2, and R -3 Districts accessory structures are <br />limited to 728 square feet in size with administrative approval. There are no size limits to <br />accessory structures in any other zoning districts. Through a site plan review, the City can <br />approve deviations from the Code for accessory structures in exceptional and unusual <br />circumstances. However, regardless of the circumstances accessory structures in residential <br />districts are limited to 1,458 square feet in size (twice the size of a 728 square foot structure) <br />without an approved variance. <br />The proposed amendments would allow non residential uses in the R -1, R -2, or R -3 Districts <br />to have accessory structures up to 2,184 square feet in size (three times the size of a 728 <br />square foot structure). Because all non residential uses within these Districts are conditional <br />uses, any proposed accessory structure would require Planning Commission and City Council <br />approval regardless of its size. The proposed amendment goes further to require an <br />accessory structure exceeding 2,184 square feet to receive a variance in order to be <br />constructed. <br />When reviewing a Zoning Code amendment or addition, it is important to consider how the <br />change would affect the entire zone instead of one specific property.
