The <br />City Forester inspected the praperty and determined that this tree had been previously anarked in <br />2008 for remaval %r Oak Vililt Disease. StafF deterrz�ined that the owner did not responc� to City <br />notices during tbat time to remove this tree. The tree is naw campletely dead and in the opinion <br />of the City Forester, poses eminent danger to �ife or property or to adjoining properties. The <br />property is in violation of Section 602.03 Subd. 21: Dead, diseased or fallen trees or �ree <br />branches not removed within a reasonable period of time. This type o� violation requires the <br />City to use the General Abatement Pracedure process in Section 602.05 of the City Code. <br />T�e General Abatement process states that a written natice of violation shall be served by the <br />officer charged with enfarcement on ihe owner of record or occupant of the premises either in <br />person or by certified or registered mail. The notice shall describe the facts which are in <br />violation of the Ciry's pubIic nuisance regulation; the specific City regulation which have been <br />violated; the type of action necessary to abate the violation; and deadline for compliance. The <br />property owner has not contacted the Ciiy to resolve the situation. A violation letter was sent hy <br />certified maii on November 8, 2010, giving the owner 10 days to correct this situation. The past <br />office attempted three times to deliver this letter, with no success. Tk�e certif ed letter was <br />ret�.irned to the City unopened.
