_ __ _ <br />City of Arden Hills Chapter 13 Zoning Code <br />shall be issued for any use in a zoning district wk�ich requires the issuance <br />of a conditional use permit before it can. be locaied in the particular <br />district, until after the conditional use permit I�as been granted by the <br />Council. <br />F. Discontinuance of a Conditional Use. If the use for which any <br />conditional use permit has been granted has ceased o� has been <br />discontinued for a period of ninety (90) consecutive days, the permit shall <br />automatically expire and become void at the end of such ninety-day <br />period. <br />Subd.4 Variaa�ces. <br />A. Public Hearing, A public hearing is not required but neighboring <br />property owners shall be notified. <br />B. Action to Approve. A majority vote of the Council is required for <br />action to grant a variance. <br />C. Intent and Purpose. Variances from the Iiteral provzsions of the <br />Zoning Code may be granted in instances where the strict enforcement <br />would cause undue hardship because of circuznstances unique to the <br />individual property under consideration. Va�riances sha11 only be granted <br />when it is demonstrated that such actions will be in keeping with the spirit <br />and intent of the Code. "Undue hardship," as used in coz�nection with the <br />gran#ing of a variance, means tkxe property iri question cannot be put to a <br />reasanable use uz�der conditions permitted by the Zoning Code, the pligl�t <br />of the Iandowner is due to circumstances unique to the property not <br />created by the landowner, and the variance, if granted, will not alter the <br />essential character of the locality. Economic considerations alone shall <br />not constitute an undue hardship if reasonable use for the property exisis <br />under the te�ns of the Code. <br />D. Variance Restrictions. In no case shall the granting of a variance <br />i�npair the health, safety, camfort aaad general we�fare of the public, nor <br />wili it be contrary to the intent and purpose of the Comprehensive plan, <br />the official map, ar this or any other ardinat�zc� of the City. Variances to <br />allow a use that is not permitted in the district shall not be granted. <br />E. Allowable Variances. Variances normally relate to the dimensional <br />provisions of the ordinances such as, but not limited to, building setback <br />Iines, lot area requirements and the like but may also relate to othex <br />req�irements, regulations or procedures. <br />F. Conditions to Insure Compliance.
