_ _____ <br />City of Arden Hills Chapter 13 Zoning Code <br />Subd. 3 Conditional Use Permits. <br />A. Publzc Hearing. A public hearing xs required. <br />B. Action to Approve. Action to approve a conditional use permit <br />requires a majority vote of the full Council and must include a <br />determination that the facts and circumstances of the particular case <br />warrant gxanting the permit. The Caux�cil shall consider the factual <br />findings, conclusions and recommendations of ihe Planning Commission, <br />as contained in its report, and both shall consider the effect of th� <br />proposed use upon the health, safety, convenience a�nd general welfare of <br />the owners and occupants of surrounding land, in particular, and the <br />community as a whole, in general, including but not limited to the <br />following faciors: existing and anticipated traffic and parking conditions; <br />noise, glare, odors, vibrataon, smoke, dust, air pollution, heat, liquid or <br />solid waste, and other nuisance characteristics; drainage; populatian <br />density; visual and land use compatibiiity wiih uses and stx`uctures on <br />surrounding land; adjoining land values; park dedications wh�re <br />applicable, and the orderly development of th� neighborhood and the city <br />witlain the general purpose and intent ot' this Zoning Code and the <br />Comprehensive Development Plan for the City. <br />C. Irnpositian of Conditions. In the granting of a conditional use permit, <br />the Council may impose such conditions, in. addition to the general <br />conditions and requirernents of this Code to which every conditional use <br />permit shall be subject, as it deems necessary to serve and protect the <br />health, saf�ty, convenience and general welfare of the commuruty. Sucl� <br />conditions may include, among ather things, a time limit within which the <br />conditional use or a portion thereo% or improvements in connection <br />therewith are to be established, constructed, completed or commenced, <br />and a requirement that the person or firm to whonr� the conditional use <br />permit has been granted deposit with the City either cash or a performance <br />bond in a surx� equal to one hundred twenty �ve (125) percent of the <br />estimated cost, as determined by the City Engineer, of improvements to be <br />constructed in accordance with the permit to insure completion thereof <br />within the t�me limit specified in the permit. The conditions so irnposed <br />by the Council shall be specifically sfafed in the permit and maybe subject <br />to periodic review as determined by the Cotu�.cil. The violation of any <br />special or general condition set forth in a condztional use permit shall <br />co�istitute a violation of this Code. <br />D. Permit for Particular Site. A conditional use permit is granted for a <br />speciiic use at a specifzc site, not for a person or �rm. <br />E. Desigr�ated Uses.
