The application and the adr�inistrative and revzew procedure <br />established zn Section 13SSA4 Subd 3, Canditional Use Permits and in Appendix A, <br />Procedural Manual, shail he foliowed for all development that involves new building <br />construction, modificatian of a building's exterior or modification of the site. Conditional <br />use permits are not required for permitted uses that occupy approved buildings that do not <br />rec�uire exter�or bUilding modification or site modificatzoz�. This provision is subject to <br />any modifications or additions set forth in this Section. The prescribed procedur� may be <br />madified by the City to allow p�az3ning flexibility and to enco�rage cooperative dialogue <br />between the applicant and the City. <br />Subd.3 Pe�-mitted Uses. Permitted uses a�•e allowed as speeified in the Land Use <br />Chart, Section 1320.05, for the B-3 District. <br />Subd. 4 Uses Allowed by Conditional Use Perrnit. <br />A. The above per�x�itted uses, if construction of a new building, modification <br />of a buiIding's exterior, or modification of the site is involved. <br />B. Uses allowed by Condition�l Use Permit as specified on the Land Use <br />Chart, 1320.05, for the B-3 District. <br />Subd. 5 Special ReguIations for Drive-�n Businesses and Fast Food Restaurants in the <br />B-3 District_ Section 1325.04 of ihis Code, specifies additional requirernents for drive-�n <br />businesses, fast food restaurants and automobile service stations. This paragraph (Subd. <br />4) is a pz'ovision whereby the proxi�nity reqnirement of one thousa�d t1�ee huridred and <br />twenty (1,320} feet between drive-in businesses or fast food restaurants may be waived if <br />the following conditions are met: <br />A. Tk�e operation consists of one or anore drive-in businesses or fast food <br />restaurants and is an integral part of a building containing one or more other <br />aIlowed uses, or the operation is part of ar� architecturally unified "food court" <br />or "drive-in service court" complex containing two or mare restaurants, fast <br />food restaurants or �rive-in businesses_ <br />B.
