City of Arden Hills Chapter 13 Zoning Code <br />i355.03 <br />Subd.4 Council Consideration. Yn considering applications, the Council shall <br />cons�der th� advice and recommendations of the Cornrnission and may approve the <br />requ�st if it determines that the request is permissible in accordance with the city <br />standards. Such applications may be denied by action of the Co�ncii, ar�d such action <br />shall constitute a finding and determination that the conciitions required for approval <br />do nat exist. <br />Subd.S Action by CounciL The Council z�ust take ac�ion on the application <br />within sixty {60) days following the report to it by the Commission or following a <br />hearing (option.al) held by the Council. Council action rnay include approva�, denial <br />or referral back to the Co�mission. <br />Application Requirements For Ali Land Use Procedures. <br />Subd. 1 Application. The applicant for City review o� any land use procedure <br />requiring action by the Planning Commission and City Council shall fill out and <br />submit to the zoning admi�zstrator, the completed application form, and all required <br />documentation. <br />Subd. 2 Documentation. Forms describing the required doc�nentation for each <br />procedure required hexein are included as Appendix A, Procedure Manual and are <br />available from fihe zoning adminisirator. <br />1355.04 Procedural Requirements for Specific Applications. <br />Subd. 1 <br />Subd. 2 <br />Zoning Code Amendment. <br />A. Public Hearing. A public hearing is required hefore action by the <br />Council. <br />B. Action to Approve. A 4/5 vote of the full Council zs required for <br />action to amend the Zoning Code. Tn the event an application for <br />amendment is approved, an appropriate amending ordinance shall be <br />e�ecuted and published. <br />Rezonings. <br />A. Consistency with Comprel�ensive P�an. If a proposed rezoning is not <br />consistent wiih the Arden Hills Comprehensive Plan the applicant shall <br />apply for a Comprehensive Plan Amendment concurrently with the <br />application for rezoning. Writien and graphic documentation shall be <br />provided by the applicant, showing why the proposed amendment is <br />superior to the existing Plan and changes that have occunred that rnake the <br />Amendment appropriate. <br />Section 1355 — Administration and Procedures <br />Adopted: November 13, 2006 <br />Page4of14 <br />
