City of Arden Hills Chapter 13 Zoning Code <br />B. Public Hearing. A public hearing is xequzred for a Comprehensive <br />Plan Amendment and for the rezoning. <br />C. Action to Approve. A 4/5 vote of the full Council is required for action <br />to rezone property from one dist�ict to another and for a Comprehensive <br />Plan Amendment. In the event an application to rezone is approved, an <br />appropriate arnending ordinance shall be executed and pubiished. <br />Rezoning amendments shall describe �he property rezoned by its legal <br />description, and shall be indicated on the ofiicial zoning map, but it shall <br />not be necessa�ry to re-publish said zoning map to effectuate the rezoning <br />amendment. <br />D. Business and Industrial Disirict Rezoning. Before any new area is <br />rezoned to a business or indust�ial classification, the property must be <br />located adj acent to an arterial or collector road as shown on the <br />Comprehensive Development Plan, or the rezoning wzll be an extension af <br />an existing b�zsiness or industrial disfrict and in conforn�ance with the <br />intent of the Comprehensive Plan. <br />Subd. 3 Conditional Use Permits. <br />E. �ublic Hearing. A public hearing is required. <br />F. Action to Approve. Action to approve a conditional use permit <br />requires a majority vote of the full Council and must include a <br />determination that the facfis and circumstances of the particular case <br />warrant granting the permit. The Council sha11 consider the factual <br />findings, conclusions and recommendations of the Planning Commission, <br />as contained in its report, and both shall consider the effect of the <br />proposed use upon �he healtl�, safety, convenience and general wel�are of <br />the owners and occupants of surrounding land, in particular, and the <br />community as a whole, in generai, including but not limited to the <br />following factors: existing and anticipaied tz-affic and parking conditions; <br />noise, glare, odors, vibration, smoke, dust, air pollution, heat, liquid or <br />solid waste, and other nuisance characteristics; drainage; population <br />clensity; visual and land use compatibility with uses and structures on <br />surrounding land; adjoining land values; park dedications where <br />applicable, aa�d the orclerly development of the neighborhood and the city <br />within the general purpos� and inte�t of this Zoning Code and the <br />Comprehensive De�relopment Plan for the City. <br />G. Imposition of Condifions. Iri the granting of a conditional use permit, <br />the Council may impose such conditions, in addition to the general <br />canditions and requirements of this Code to which every conditional use <br />permzt shall be subject, as it deems necessary to serve and protect the <br />health, safety, convenience and general welfare of the community.
