City of Arden Hills Chapter 13 Zoning Code <br />reaso�able use under conditions permitted �iy the Zoning Code, the plight <br />of the landowner is due to circumstances unique to the property not <br />created by the Iandowner, and the variance, i� gxanted, will not alter ihe <br />essential character of the locality. Economic considerations alone shall <br />not constitute an undue hardship if reasonable use for the property exists <br />undez the terms of the Code. <br />D. Variance Rest�-ictions. In no case shall the granting of a variance <br />impair the health, safety, comfort and general welfare of the public, nor <br />will ii be contrary to the intent and purpose of the Comprehensive Plan, <br />the official map, or this or any other ordinance of the City. Variances to <br />allow a use that is not permitted in ihe district shall not be g�-anted. <br />E. Allowable Variances. Variances normally relate to the dimensional <br />provisions of the ordinances such as, but not limited to, building seiback <br />lines, lot area rec�uirements and the like but may also relate to other <br />requirements, regulatians or procedures. <br />F. Conditions to Insure Compliance. The Council may impose conditians <br />in. the g,ranting of variances to insure compliance and to protect adjacent <br />praperties as well as the health, safeiy, comfort, and general welfare of the <br />public. <br />G. Height Variances. Variance to height of structure may be granted in <br />accordance wiih Chapter 1325.03 Subd 3. <br />Subd. 5 Site Plan Review. <br />A. Public Hearing. A public hearing is not required but neighboring <br />pz-operty owners may be notified. <br />B. Action to Approve. A ma�ority voie of the Councii is required for <br />approval of a site plan. <br />C. Building Permit. The issuance of a permit for a new building or <br />significant site modification for a permitted or established use within a <br />M�ltiple Dwelling Zoning District or any business or indust�iai zoning <br />dist�.ct shall require site plan approval by the City accordi�g to the <br />procedure defined in Chapter 1355.04. <br />Subd. 6 Planned Unit Development (PUD). <br />A. Two or Three Stage Process.
